Do USCIS check text messages

So this is a post for one of the girl I know... She is about to remove condition just like I am, however she's also considering filing for divorce. I know they entered the marriage in good faith since both her and the USC have been my friends. Now the marriage is not working out so well (they still live together) and they talked about options of filing for divorce in near future.

She is paranoid on the whole text message issue because she has been texting me and other friends talking about her issue, and she said something like 'I want to stay married until I get my permanent GC card' or something like that. She thinks USCIS would monitor her messages and use that as an evidence of fraud... is it fraud? I'm not sure but before she actually spend money on consulting attorney I want see if I can get any insights here...

You asked a question and the person replied. Maybe you didn't liked they replied but then do not ask the question.

Yes they have both entered in good faith. What the user i talking about is that she only wants to stay married to she gets her green card which seems odd since she is able to get it herself with a divorce.

Ok that's fair, I posted this in order to get answer for a specific question. Since It's not my case I won't argue / explain why she chooses to do so anymore. If there is any insights to my question then appreciate it, otherwise sorry I can't satisfy y'all curiosity.

Thanks for the reply, I think what she might be trying to do is to see if they can still make it work, getting divorce is a big deal so no one wants just to do it like snapping fingers. It's just during her text conversation with me and several other girls she mentioned her immigration status is also a concern but not the sole reason of not getting divorce.

I guess I was getting a little defensive for my friend, I mean 7 years (5 years of dating and 2 years of marriage) is a long time so it's really sad to see things not working out between them, But at the meantime, neither she nor her husband wants an immediate divorce, for the sake of last attempt of saving marriage, living situation, mutual property, work situation, family and also immigration. I understand the whole 'you should terminate the marriage once it's not working out and file application on your own' thing but life isn't just black or white right? I want to help her get a peace of mind because I don't think this is something worth spending 200 + dollars on a lawyer consultation...

Sorry but isn't it worth it based on all you said? Some consults are free. Albeit not sure what questions you want to ask.

Two of your statements that you wrote in two different posts sound contradictory. One either stays married for a green card or doesn't. I don't see how there can be a spectrum in this. Would your friend have stayed married had the spouse been a citizen of another country? Part of your question was "Is it fraud?." To me, based on just what you wrote, it does sound like fraud, even if she's been married to USC spouse for 7 years.

It's not fraud, but I'm getting tired of explaining the situation, sorry, she will probably consult a lawyer anyway, thanks for the reply so far.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The government has a higher access to messages of any form from outside the US to inside the US. They have little concern about messages starting and ending inside the US. ( But there is still some monitoring ) It may actually be riskier to file jointly than file based on a divorce if your "friend" has proof of a valid relationship in the beginning. Should the relationship take a total dive between filing an interview and the other party stop being so generous in "helping" you could face a denial and the need to refile and repay.

This will not be over quickly. You will not enjoy this.
