Hello Everyone.

After we got and RFE saying that the joint sponsor does not meet the requirement, which we did not understand because he does, we found another joint sponsor and now we are filling up the form I864.

Because the joint sponsor and her husband share the same bank account, as we understood from the form Part 6 Question 11 , the joint sponsor's husband has to fill up a separated I864.

Is that right?

please we need your help as soon as possible.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If the joint sponsor makes enough for their own household size plus the intending immigrant, then the husband does not have to fill out an I-864A. Be sure to read the instructions and provide everything required, such as a copy of the joint sponsor's W-2s and/or 1099s if they filed taxes jointly with their spouse.

You mention a joint account though. Is the joint sponsor using shared assets? If that is the case, then yes, the husband should fill out an I-864A to go along with the wife's I-864 for joint sponsorship.

There can be no second joint sponsor for one immigrant, so yes, that is a problem. The spouse needs an I-864A as a qualifying household member. They need to redo the I-864 and add in the I-864A instead.

I have another question for you please: In the RFE they asked for w2s,1099s,form 2555,and tax schedules.

we got most of the forms they asked for but no 2555. because they asked their taxman to collect the forms for them and he did not send that one, instead we have proofs of assets,stocks , bonds ....and also a statment from the bank ... ( more than 3 million$) and their income is very good ( more than 200k$).

Do you think I will be asked for other forms again?? if we dont send the 2555( foreign earned income) because they dont have it.?

If that form is not part of their taxes, then it is not needed. They just need to send a complete copy of their return, with all forms, schedules, W-2s and 1099s, or an IRS tax return transcript.
