I've heard different opinions on this matter, or maybe I"m simply confused and the answer if obvious.

I do not have an EAD.

I received my social security card, it is not marked in ANY way that I am not work permitted.

the instructions that came with it (amongst many other instructions) state:

"if you are an alien without permission to work in the U.S., your social security card will be marked "NOT VALID FOR EMPLOYMENT". We will notify U.S. immigration officials if you use the number to work

If you are an alien legally in the U.S. with temporary permission to work, your social security care will be marked "VALID FOR WORK ONLY WITH DHS AUTHORIZATION".

My card is not marked either way.

It is a simple, normal, everday SS Card.

Did I get lucky, and Can I use it to work? OR will I run into problems with my AOS?

Theoretically, No

that being said, it is forgiven

How did you get your SS card? What did you have to show when you applied for it?

Most people have to show work permit or other ID to obtain SS card.

My advise is to follow the letter of the Law if you know you are NOT authorized to Work in the USA then I wouldn't expecially if you are awaiting AOS.

I would suggest asking an Immigration attorney.

Kudos to you for inquiring & wanting to follow the Law, most people would simply knowingly break immigration laws to their benefit.

To get my Social I got it like I'm saposed to ! I used my K-1 Visa. I had to show my Birth Certificate, Drivers Lisence (Montana), K-1 Visa I-94, Marriage Lisence (name change) And I think that's all.

Do you feel that the rules do not applly to you because SSA issued you with the wrong card....

If you did not need an EAD to be able to work then why would we all have to file for one along with our AOS...

Yes unauthorized work is normaly forgiven at AOS interview when you are married to a USC....

Question you have to ask yourself is "is bending the rules worth any risk that might put a ? over my AOS?"

The reason I am asking these questions is because I've heard several ppl say that you CAN work on a K-1 for the 90 days after entry without an EAD, and some say another 90 after that (the time you have to file for AOS)

I didn't KNOW if receiving this social card on a K-1 was normal

that's why I am asking.

I was not suggesting OP obtained SS # unlawfully, just was not aware of K1 process for SS card,

If your K1 allows you to work then you shoul dbe fine, Once again I advise to follow the Law.

Just because you found a way around the rules does not mean you should break them.

Ask an Attorney that way you get a straight answer, instead of opinions

"Some I-94s issued to K-1s are stamped or annotated 'EMPLOYMENT AUTHORIZED,' and some are not. Either way, the I-94 is proof a K-1 alien is authorized to work."

So...is this incorrect or what?

This is the Grey Area I'm TRYING to figure out...

Careful what you ask everyone will you think you're trying to get around the law vs figuring out it!!! ;) (still not sure how I "figured out a way to get around the law")

it is only good till the expiration date of the I-94, then you should have a Employment Authorization Document.

the I-9 states that the I-94 must be stamped "employment authorized" for it to be used

I asked about this this morning and was given the answer of there was NO way my husband was authorized to work until he received his EAD. If the K-1 allows him to work for the first 90 days that he's in the country (beginning the day of entry), then he IS authorized to work up until the expiration date. By that point, we will hopefully have his EAD.

I'm not angry, I'm just very frustrated about inconsistencies. It's a very confusing process, and even moreso when people give incorrect information.

If your husband has a temp EAD stamp on his K1 then he is work authorized and had the evidence needed to show an employer and can be hired.... if he does not have the temp EAD on his K1 the although the K1 visa allowes for employment, without the temp EAD stamp he has no evidence for the employer to be able to comply with the requirments of the I-9 form and that means he can not be hired or should not be hired.....

...despite the fact that it says that K-1 visa holders are authorized to work up to 90 days without EAD regardless of having a stamp?

It makes no sense.
