I think that I may already know the answer to this, but I keep getting different answers on it, maybe someone here could help me. My wife came here on a K-1, we messed up and married before we applied for her SSN, is it too late to apply for a SSN? I talked to an immigration officer who informed me that she's still technically a K-1 until we actually submit the papers to USCIS, so that would technically allow her to still recieve a SSN. I really don't want to lie, or not disclose the fact that we did indeed marry to SS. Any opinions?

From my understanding your SSN is tied to your I-94 and not your marraige status in this case.. My assumption here is that you haven't filed for AOS yet.

The guide works, if you do what it says and go to SSN office they will help you out. I didn't give my SSN when I got married (I had one but it was in an old "married" name"). I went to update after my marraige, no questions asked.

I am 100% unsure why you feel you did something wrong. Maybe I missed something, and I did something wrong!

I got my Social after I had married on my K-1.

She's still here on the grounds of her K-1 visa, the only difference if her name has changed. As long as the Visa hasn't expired or isn't CLOSE to expiration ( 1 week away) You shouldn 't have a problem.

Tell her to go into the Social Security office, to take her Birth Certificate, Marriage Lisence (or certified copy), Visa, Drivers Lisence. And apply! You just need the marriage lisence to prove the name change.

Good luck on your immigration journey. From my experience, I applied for SS# and got my SS# after I got married, and a few weeks after I got my Green Card (as they would not give me a SS# beforehand anyways). You don't need a SS# to apply for the AOS (which is your next step).

Besides, it is easier to apply for it after you get married, as you don't have to make an extra trip to change the work-only status and/or last names on the SS# card after you get married, as when you apply for it after, your SS# will already be unconditional status and in your wife's new last married name.

You should be able to still get a SS#. But today when I went to change my name on my SS# cause we just married, the woman informed me that I couldn't change my name to my married name until my Status has been adjusted. So I am confused..

I don't know why the workers at SS make it so hard. It's almost as if they make a commission on denying people the ability to apply for a SSN, or to make it as difficult as humanly possible.

We waited till after the marriage to apply for my wife's social security card and it still had the work-only status stamped on it. Was it not supposed to be stamped?

I got my SSN AFTER getting married. Just take her Passport with the I-94 and the marricage certificate to the SSA.

My husband just got back from the Social Security office here in Chicago where they stated that he was NOT allowed to get a SSN at this time because we got married, which makes his K1 visa null and void (and he'd have to wait for AOS and EAD).

Are they horribly confused? Is there a government document that he can take back to the office and show them?

Just make sure you apply for the SSN BEFORE the K1 visa expires (still 90 days after date of entry?). If you wait until after it expires then you will have to wait until your AOS is complete. Somebody I know found this out the hard way.

He did and he mentioned that it does not expire until May, but the woman at the SS office insisted that because we got married and have our marriage certificate that K1 is not valid, and he has to go through USCIS to get a SSN now which makes NO SENSE.

I feel like I'm taking crazy pills.

Anyway, if someone can just direct me to any sort of document that says "K1 is valid until the 90 days are up regardless of marital status" I would greatly appreciate it. We'll print it and take it to the SS office to show her she's crazy.

The problem is that the employees at SS don't get continuing training. They only know the policies that they were trained on whenever they started. And, of course, them being government workers, they're not going to go the extra mile to learn a policy that may help you. I'm just going to wait until my wife's EAD, it's not worth the hassle.
