RFE after 1 year and 2 weeks after the interview

Hello,
Married on December 2010
Filled I-130 / I-485 on April, 23rd 2014
Interview for I-130 / I-485 family based on October, 23rd 2014.
Since then our case was on pending consideration status.
Today we received this RFE and another paper to do the biometrics again!
Do they want just Form I-693 (Medical and Immunizations) or what?
We are confused ...
Is this a good sign for us or not?

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Timeline

Since it has taken so long, they are needing you to re-do your biometrics and medical. It is probably a good sign that they are asking for these things in order to process your case. Nothing else is checked off on that RFE. It is the I-693 they need.

At least you got something... It means they looked at your case. Have you tried contacting your senator, congressmen, anything, anyone? 1 year is way too long! Best wishes! :)

Man this scares the heck out of me. I haven't heard anything since my interview on 10/1/2015 and I think that is way too long. I can't imagine having to wait a whole one more year.... was there any reason that you know of for why your application got delayed so much?

9/9/2018: N-400 Application submitted ONLINE. Estimated case completion: November 2019 (14 months).

9/10/2018: NOA

9/15/2018:Scheduled for Biometrics appointment. Scheduled for 10/1/2018

10/1/2018: Biometrics completed. 

4/11/2019: Scheduled for Interview.

5/20/2019: Interview day, APPROVED!

5/30/2019: Oath Ceremony. Officially a US citizen! Time to Vote :D

2/27/2015: Sent I-612 + Affidavit and supporting documents (This was sent to California Service Center)

3/4/2015: USCIS received I-612 and sent Form I-797C notice of action in mail which I received later on.

4/9/2015: USCIS requested another non-USCIS advisory opinion for Form I-612

4/14/2015: From I-612 and I-613 were received by the DOS

5/6/2015: DOS: Post input: received,

6/27/2015: DOS decision turned to Favorable recommendation, Recommendation sent on 6/26

My lawyer said we can sue the USCIS to do their job .... writ of mandamus ... but I will be patient a few more months.

In my case they must give me the permanent GC not a temporary one. I've been married with a USC since December 2010 .... thinking that's why is taking so long ..

Yes, you can file a writ of mandamus but if you are in security checks and you force a decision with doing so then they can outright deny you.

You then start over with the same security checks that needed to be completed.

At the end of the interview our IO said:
"Congratulations, you've been approved for Permanent Resident Card. You will receive your card by mail within 10-14 days. After 3 years you could apply for US citizenship!

My questions is: could an IO say all of these without having all my security checks cleared? I don't think so ....

Ombudsman is one of the ways you can use to help get some answers. Did you get an answer from them? Why don't you contact your senator? They really can help a lot. Just Google senator for your state and email them.

And yes, you can sue USCIS for holding your case for decision.

And if your IO said you have been approved, did he give you the approval letter or he just "said it"? Did he give you anything, any letter?

In September 2015, my wife did the Ombudsman Case Assistance online.

We got after 2 weeks an email saying they will forward the documents to USCIS.

Then after another 2 weeks or so I got the RFE for medical to be done again and the fingerprints also.

We gave the papers to our lawyer we hired in April 2015 and he delivered the medical envelope to our IO by hand just before Thanksgiving day.

The RFE letter was saying:

"REQUEST FOR EVIDENCE

The documentation summited during the adjustment interview is not sufficient to warrant a favorable consideration of your petition / application.

The following information is also required see please the following sheet ..... blah blah blah ... I-693 the only one marked on attached paper.

We did not contact a senator.

I have no idea if my security checks cleared (nobody told me - yes or not) but as I said I don't think our IO said those words at the end of the interview without beeing sure the security checks cleared.

She said word by word "Congratulations, you've been approved, you will receive the card by mail within 14 days, you will receive a permanent resident card because you've been married since December 2010 and has been more than 2 years since you got married and after 3 years you could apply for US citizenship."

DONE! BYE and BYE!

She did not give us a letter or anything else and we did not have a lawyer at the interview. We did not have money to hire one also we did not know about that welcome letter, etc. at that time.

Later we figured out on this forum about it.

The whole thing is, that after we got married we went into huge financial problems, medical problems (me), my wife lost her job, etc. We did not have money to hire a lawyer or to apply for GC until 2014 ....

I believe is not a crime to not have money! Huge bad luck for us!

No,its not your fault nor a crime you didn't have money ! :) Your IO should have given you an approval letter because you would have some kind of a proof (and if they give you the approval letter, your GC comes with the day that letter was given - since its an approved case, so you're not losing time for naturalization).

All I can tell you at this point is make sure all the documents were sent out that were requested (which they were) and give them some time to respond. If they don't respond in a timely manner, talk to your lawyer about sending letters to your IO and sending emails to senator. That helps if your file is just laying on the IO's desk to be approved!
