Hi everyone,

this is my case: I entered the USA with a tourist Visa a year ago, so as u can see I overstayed here for more than 6 months. Recently I married an american citizen and we want to travel arround the country and to Europe the next year, so these are the questions.

Is there is any problem now that I overstayed with my tourist visa?

I understand she needs to fill the I-130 and I have to fill the I-485, what other forms do we need to fill?

If we want to travel to other states after sending the forms is there any risk of being deported if I got through any control points between states?

What form do we need to fill to travel abroad before I get the green card?

Wow, are we not supposed to help people with immigration issues when they come here asking? They overstayed, yes. They can also still legally adjust status based on being married to a USC. The law allows it, period. You don't like the law? Then take that up with the government. They make them, and not the OP.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

Once you file for AOS, you will be in a period of authorized stay while waiting for your green card to be approved. Yes, you can travel domestically within the US between states. I would carry a copy of your marriage certificate and receipt notice from filing the I-485.

November 10, 2011: Interview - APPROVED!!!

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
