Hey all,

I had some questions before I submitted the AOS packet for my husband (French citizen).

1) He's a J1 with no 2 year home requirement on the Visa - he teaches French language at a major US University. Just want to confirm we don't need to go through a lawyer? We're following the Guide here on Visa Journey and it said J1 needs a lawyer usually, but he doesn't have the 2 year rule applied to him at all. Just want to confirm...

2) For the fee payment - is it better if the checks come from me of from him or does it not matter for payment? Is one check better or two? Also, when he goes for fingerprinting does he pay for that fee there at the center or do we mail it in with the I-130 and I-485?

3) Alien registration # - my husband doesn't have one now as he's here on a J1, but he had one in the past. Do we need to list the old # on any forms since he used to have one or do we just put N/A since he doesn't have one now?

4) EAD card - should we apply for an EAD card now even though he's already working for a major US University? I'm jus thinking that it might be a good idea since his employment ends in July and if we don't have the green card by then or can we just apply for the EAD later if he doesn't have the green card yet?

5) Medical Exam - he had his medical by a civil surgeon and passed last week - they gave him a copy in a sealed envelope. Since we need to make 2 photocopies of everything in the packet per the Visa Journey Guide is it OK if we open the medical exam envelope from the doctor or no leave it sealed?

6) Interview - we both live in different states (we met when we were living in the same state), but his job put us apart. I'm planning on moving to him next year sometime. When the interview comes up what location will they assign us? One close to me as the petitioner or one closed to him as the person who is getting the AOS? I live in New England and he lives in the Midwest.

7) I-864 - for the affidavit for support. I work full time and make 45K -he also is paid by the university in the US that he teaches at and makes 44K - do they count his income as well or do they just look at mine even though he works full time too. I know we need an I-864 for both of us right?

8) I-130 - stupid question, but on section C of the I-130 I'm filling out where it says "list Spouse...." do I put his name here in Section C again even though he's listed at the top to the right of my name as the relative I'm sponsoring? Also under section C - address where your relative intends to live - He has his own apartment where he lives and pays for - do I just put that address there?

9) Certified Copy of Marriage Certificate - can it be a copy of the certified copy of should I just go to the clerks office and get more certified copies? We need two correct? One for the I-130 app and one for the I-485... just want to confirm!

01/10/2016 - Received RFIE - requesting proof of I-130 sponsor being US Citizen

01/12/2016 - FedEx RFIE Response

01/14/2016 - USCIS received RFIE Response

01/27/2016 - Ready to be scheduled for INTERVIEW

02/16/2016 - NEW CARD BEING PRODUCED / I-765 Case Approved

02/19/2016 - NOA2 Approval for I-765 received / EAD Card was mailed

02/23/2016 - EAD Card arrived today via Priority Mail

11/02/2016 - Interview Scheduled for 12/01/2016 !!!

12/01/2016 - Interview date (Interview cancelled on 11/18/2016)

01/12/2017 - ACTUAL INTERVIEW IN ST. Louis (need to get new medical submitted)

01/19/2017 - New medical dropped off at USCIS & CASE APPROVED ! I-485 & I-130

01/25/2017 - GREEN CARD IN HAND! - DONE!!!!!!!

 

ROC Timeline

11/25/2018 - Mailed I-751 packet to Dallas address

11/28/2018 - I-751 packet showing as DELIVERED to USCIS in Dallas

12/04/2018 - Check cashed 

12/19/2018 - I797 NOA received in the mail (18 month extension) - Vermont Service Center

12/24/2018 - Biometrics Letter Received (appointment in early January)

01/03/2018 - Biometrics complete

12/17/2019 - New Card is Being Produced (approval following day and card mailed on 12/20)

12/23/2019 - 10 Year Green Card DELIVERED !!!
