Scheduling interview takes too long :(

Hi. Me and my husband (US citizen) applied for my GC at May 23rd 2015.

On July 8th I got email we ready to be scheduled for an interview.

Today November 9th and still nothing.

I called USCIS( Denver office) and they say "We are very busy, And now on interview went people who applied November 2014, so you need to wait probably a year!

I'm really confused because they say that they schedule married couples first, but ####### why everyone goes on interview 6month approximately after applying. And we need to wait whole year .

Sorry I'm just vey mad, because we want to go to Costa Rica to his sister in February 2016:(

Ah ok. I don't know about overstay issues-- those can have really huge punishments, much worse than waiting a few extra months or missing a vacation. I'd listen to your lawyer on that one for sure. I was told to expect the GC to take a full year, so I don't know if what you're dealing with is normal or not.

But I hope you can make it-- Costa Rica is nice

The system is backed up and there are delays for married couples as well. You will just have to wait.

I overstayed my visa waiver and I travel with advanced parole to visit my husband's country to Guatemala on sept 2015.

You still can travel even if u overstayed your visa, as long you have a valid passport with your advanced parole.

I was told by my immigration attorney.

I overstayed my visa waiver and I travel with advanced parole to visit my husband's country to Guatemala on sept 2015.

You still can travel even if u overstayed your visa, as long you have a valid passport with your advanced parole.

I was told by my immigration attorney.

The fee for filing the I-131 (Application for Travel Document, i.e. the advance parole application) is waived if you have a pending I-485 application. Make sure that you remember to include a copy of the receipt from your I-485 application when you submit the i-131.

Typical processing time for the I-131 is about three months.

That is the fee for anyone who does not have a pending I-485. Here's what the instructions for the i-131 say:

NOTE:

If you filed Form I-485 on or after July 30, 2007, and you paid the I-485 application fee required, then no fee is required to file a request for an Advance Parole Document or Refugee Travel Document on Form I-131 if your Form I-485 is still pending, if:

1. You now hold U.S. refugee or asylee status, and are applying for a Refugee Travel Document (see Form I-131, Part 2., Application Type, Item Number 1.b.)

; or

2. You are applying for an Advance Parole Document to allow you to return to the United States after temporary foreign travel (see Form I-131, Part 2., Application Type, Item Number 1.d.).

Under these circumstances, you may file Form I-131 together with your Form I-485, or you may submit Form I-131 at a later date. If you file Form I-131 separately, you must also submit a copy of your Form I-797, Notice of Action, receipt as evidence that you filed and paid the fee for Form I-485 required on or after July 30, 2007.

Hi, Lucia21, we are in Michigan and applied in May too. We haven't even recieved the "You case is ready to be scheduled for an interview" letter yet. Our lawyer told us, that it will still be another 4-5 months. So you are not the only one waiting for a year, there are a lot of us waiting.

Oh, our lawyer strongly advised not to use AP (since I overstayed too) unless it is a life/death matter

That's what I'm saying, I don't know why they saying not to apply for advance parol:( that's weird. I'm kind of afraid now to apply and go and after to be stopped in the board .

My wife's cousin overstayed her work visa and got married. While on AOS, she went home to the Philippines on AP for Christmas in 2012, and was sent back home upon trying to enter the US.

On the bright side, she did accompany my wife back to the states in 2014 when both their CR-1 and K-1 visas were approved in January.

So while some people may be able to enter on AP, always remember, until one is a US Citizen, CBP/Immigration can deny one's entry, and neither AP nor a green card is a guaranteed entry permit to the USA.

Just a side note, it took approximately a little over a year for my wife to get her GC. We applied in March 2014, and she received an interview waiver. She did not receive her green card until April of this year.
