Got an email requesting initial evidence for my I 485..

Needless to say I am feeling dejected as I await the confirmation letter tomorrow or Wednesday.

Looks like I have to start the process again!

Reading everyone's emails earlier and then getting sent a text regards an USCIS email, I honestly believed I was receiving my EAD until I read the dreaded email..

Congratulations to all who got good news and may it bring much needed happiness.

The whole process is stressful in my opinion and not to say sickening when they send an initial evidence response!

I know it's not worth much cause I can only imagine how you are feeling right now, but i hope you can manage to keep positive...and i know it is very difficult to do so....

for now just hope that the RFE isn't going to be for something significant and that you could very quickly respond. I got an RFE for initial evidence 20 days into the process and my process didnt start from 0 again....So I'm crossing fingers that it's the same for you man!

I got on the phone immediately to ask what is it for and they can not tell me unti I receive the letter.

The lady told me that I would have to start the process all over again, regardless as it is INITIAL evidence.

Unfortunately it stops while application in have been told.

If I somehow would of got the EAD card I could live a bit longer with my green card but I just fear now that I have to pay the whole applications fees for a new case.

Mine was INITIAL evidence too!! And they said the same thing to me!!! It didn't happen. I can't guarantee that it won't happen but I can only tell you what happened to me too, and still got it in 80 days!

I also got a RFE for initial evidence as well and my husband got his EAD before our 9th day so I honestly don't believe you will start over at least not with EAD and AP.

Hi everyone

To those still waiting to hear about their EAD and AP:

AOS, EAD & AP applications received by USCIS on 18th November 2015.

EAD case status changed to "Application was approved" on 3rd February. My case status for the AP has never changed from "Application was Received."

Today, 8th February, I received my NOA I-797 which states:

"Your application for employment authorization and advanced parole has been approved. The Form I-766, Employment Authorization Document with I-512 endorsement, will be sent to you separately." It goes on to read, "The Form I-766 with I-512 endorsement is also evidence that, while your Form I-485 remains pending, you may travel abroad without abandoning your Form I-485."

I understand that others have had the same issue, their EAD status being updated but not their AP. I just wanted to share my experience and reassure others that, if this happens to you, chances are they will both in fact be approved. Fortunately a couple of VJ members were able to advise me at the time of the same :)

Best of luck to everyone still waiting!

K1 Application Process
20th November 2014: Form I-29f sent recorded delivery to USCIS Lockbox
1st December 2014: USCIS received I-29f and sent application to Texas Service Centre for processing (confirmation email and text sent to petitioner on 4th December 2014)
7th January 2014: No sign of NOA1 receipt. My fiancé (the petitioner) contacted USCIS and was told they would send out a new receipt.
27th May 2015: Confirmation on USCIS website that case was approved. Waiting for formal NOA2. 177 days since application.
21st June 2015: U.S. Embassy in London received pack.
3rd August 2015: Medical completed and completed Notification of Applicant Readiness form.
19th August 2015: Letter received from U.S. Embassy in London with interview date: 14th September 2015. 287 days since I-129F September 2015: K1 Visa approved!
17th October 2015: Married!

Adjustment of Status (AOS) Process
16th November 2015: Filed AOS paperwork along with Employment Authorization Document (EAD) and Advanced Parole (AP) requests.
19th November 2015: NOA1 received.
15th December 2015: Attended biometrics appointment.
2nd February 2016: Completed electronic service request for EAD. System wouldn't let me complete one for AP.
3rd February 2016: Received electronic notification via the USCIS app that my EAD was approved. AP case status never changed from "Application was received".
8th February 2016: Received NOA I-797 for EAD AND AP.
10th February 2016: Received EAD/AP combo card. Delivered by USPS with regular mail, no signature required.

27th June 2016: Received Green Card.

Check my timeline, and you'll see that despite an RFE for Initial Evidence, and that for various reasons my Biometrics wasn't done until early January, my EAD/ AP card was still approved within 90 days.

However, the online USCIS case tracker still remains unchanged from November 27th where it states that an RFE was sent and that they will only begin working on my case again once the RFE has been received. It was confirmed delivered by USPS on December 26th, but my case tracker still remains the same as it was on November 27th.

If you filed your EAD/ AP at the same time as your AOS, you should be able to file a Case Inquiry online to nudge them. Fingers crossed you'll get your EAD/ AP any day now.

NOA - 07/21/2022

I'm so sorry they are giving you the run around JackIreland. I hope you don't have to restart the petition or anything. From what other people are saying, it sounds like the person you got on the phone was just wrong. Crossing my fingers for you and yours!

Never call the USCIS expecting anything true or helpful. :)

What you were told was wrong. Respond to the RFE for what they ask, and that's pretty much it. No starting over.

If you ever needed more in-depth assistance, you'd want to make an info-pass appointment.
