Is Tax Return Required in Manila Embassy?

We completed AOS without a tax return ;)AOS only requires the most recent tax return, 3 years is optional.

What about the affirmation on the I-864 that the sponsor has filed tax returns for the last 3 years or provide a statement why he was not required to file?

What would you suggest the OP's petitioner do? Lie on the I-864?

I would never suggest to lie.... NEVER.

I followed the instructions for the form.

What would you tell the OP's petitioner to do about the affirmation if you are not suggesting he lie? How does he make the affirmation? What would be appropriate "follow[ing] the instructions for the form?"

I am not suggesting anything, as I stated earlier - the embassy instructions letter requires his most recent tax return.

Thank you all for your information. I understand both of your points. We will never lie because we know it will jeopardize our application. But we think that there is a chance that they might approve my K1 without it and we will take that chance because we want to be together soon. And we will take care of his Tax as soon as I get there. But if they ask for it before or during my interview then we will do what is needed. He cannot pay for all the expenses of K1 plus my ticket and the possible payment option for his tax and he might need a lawyer for it at once. So we decided to take that chance...

One more question though, when are we going to need to file for I-864? Thank you

Normally you would file to adjust your status within 90 days of your entry into the U.S. If you didn't file within that timeframe, you would be out of status.

The I-864 is the financial support portion of the I-485 Adjustment of Status process. You file your AOS as soon as you can after marriage to gain legal resident status. AOS is not a needs to be filed within 90 days requirement, you need to be MARRIED within 90 days, and you can not file AOS until you are married.
