I'm really sorry as I'm sure this has been asked before, but after a quick search and reading through the guides, my specific question has not been answered.

Can you file the I-765 independent of the I-485 packet, or must you send it all together? My very recent husband would like to begin working as soon as possible, but I'm not certain we'll have the entire I-485 packet finished in time.

In a similar question - how long is it generally between filing the packet and receiving EAD?

I can't thank you enough. Please feel free to direct me to another thread or somewhere on the site. We just got married this weekend and my mind is still a little fuzzy. :P

10/23/2006 - I-129F approved (97 days from CSC)

AOS

03/03/2007 - Married!

03/14/2007 - I-485 + I-765 sent

03/21/2007 - NOA1, Checks cashed

06/01/2007 - EAD card production e-mail received (74 days)

07/27/2007 - EAD RECEIVED (57 days after approval)

11/29/2007 - Infopass appointment - file was sent to a storage facility before it was finished processing.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Removing Conditions

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail

The I-765 must be filed concurrently or after the I-485 has been filed. The I-765 cannot be filed before the I-485 as the EAD is a bebefit that is derived from having an I-485 in process.

To get a EAD based on your AOS then you need to file the forms with or after your application for AOS... if you file for EAD before you file for AOS then he will get a EAD that is valid for 90 days from entry.... and you will be wasting your money...

The average wait time for EAD is between 90 days and 100+ days.... you may be real lucky and get as AOS interview and be approved before the EAD has been approved then you wont need it... but as you will see their are many people here who have waited well over 5 months for AOS so there is no real answer to your question about how long...

Read the instructions at the bottom of right of page 3 of the I-765:

"Any EAD application other than for a replacement must be based on your pending application for adjustment based on ©(9)."

it really is not "crazypants", just think about it.

Based on what should he be allowed to work if he did not file for AOS?? an intent to file for AOS is really not enough.
