I entered the US under the Visa Waiver Program and is likely to be overstaying my visa. I know it's illegal, I know about the 10 year ban. I am sorry.

My question is, I am worried that the ICE will come search for me. I am not going to work, or get in trouble with the law. Will they come hunt me down at my house?

27 August 2015- Received email stating that our embassy does not participate in NVC'S electronic processing program therefore we should submit forms through mail (which we had already) :cry:
02 September 2015 - Spoke to supervisor Silvia about our upgrade, found out whoever reply to our email was wrong and she was going to take a look at our case :rolleyes:

09 September 2015 - Confirmed upgrade F2a to CR1 through the phone with Supervisor Silvia (she's an angel) :D
Waiting for Interview date for Naples, Italy :clock:

11 September 2015 - Interview date scheduled for 28th October 2015 :D
14 September 2015 - Received P4 letter email ( interview letter) :dancing:

20 September 2015 - CEAC status changed to IN TRANSIT :thumbs:

21 September 2015 - CEAC status change to READY

27th October 2015 - Medical exam

28th October 2015 - interview (approved!!!) :D :dance:

waiting for news about passport and visa :clock:

4th November - CEAC status changed to ISSUED

5th November - VISA in hand ... yesssss finally! #blessed

8th November - POE MIAMI (the whole process took about 45mn)

19th November - Received SSN by mail ( I had applied for it when asked if i wanted to be issued a SSN in the DS260)

23rd December- Received GC by mail (it took about 45 days from POE) finally :dancing:

IF you are that worried and have not yet overstayed, as your said you are 'likely' to, why not just return home like you said you would?

Hi, thanks for all your responses :)

To make my story simple, I have a family member who's scheduled to have multiple surgeries in a hospital.

One in August (which is why I entered using my vwp) one in Decemeber (which I would've overstayed) one more in May/June next year.

I just want to be by her side during this time, I know it is illegal, I have a source of income from my homeland. I am worried that I will be deported and left with no chance to see her

Could they hunt you down at your house? Yes, it is possible, but not likely probable as you will be sharing status with the other 11 million illegals here in the USA. ICE these days normally only goes after higher visible illegals, but it's not unheard of for them to catch low-profile illegals and deport them within accordance of the law.

What I would suggest you do is, if you can, go back to your home country before you overstay your visa. Stay out for a month and return when your relative is due for her operation.

If you are overstayed by even a day, your VWP privilege can be revoked forever. Once you overstay, you cannot even adjust status. Why would you risk deportation, a 10 year ban, and a loss of your VWP privilege just to stay in the USA without a job?

Maybe you can ask for an extension, but I think that would result in a loss of your VWP privilege, and you would need a tourist visa to come back, but at least you wont get a ban.

Isn't it better to leave now and then return when you are permitted? Then to never be able to come visit again? Never is a very long time....

I just added some info, there're multiple surgeries of my loved one here in US. Aug, Dec, May/June if she can make it

She's my girlfriend and obviously, she isn't in the right shape to get married to me (and apply for residency.)

I understand the ban, I apologize and I know I violated the law in US. I just don't want to be deported and left her here alone. What make it more likely to be deport (and I will try avoiding that)

2. Sorry for the illegal issue. I understand what I am doing is wrong, but I am hoping some advices for me what can I do with my situation. Are there any options out there? And I am scared to be deported and leave the girl

I understand all replies are from nice people and I know I am taking this risk. But I guess I value this girl more than being ban from entering US.

What if she recovers totally from being sick and you guys want to be together but can't because you won't leave for a couple of weeks so everything if legal?? You are not doing anything good for her or yourself. Go home and come back legally on VWP again before december.

1. Call the Department of Homeland Security and explain your situation. Perhaps you can get an extension on your VWP that will allow you to stay longer. Like I said, if granted it makwe revoke your VWP privileges but you may not get a ban either. From that point only a Tourist Visa would be your route.

2. Go home. Stay out a month until her operation. Return to the USA and be there for her, then leave a few weeks later. Stay out of the USA a few months then return. I know it's difficult, given your situation, but losing your VWP privilege will be a hassle in the future. I suggest discussing your situation with your girlfriend and see what she thinks.

As for removal proceedings if you overstay, I cannot give you advice on how to avoid deportation as I am a US Citizen and never really had to worry about that. However I can say that lots of illegal immigrants get deported sooner or later depending on ICE's work load. :P
