Oh I see, thank you for the links and info. I have been in the states all my life and still currently residing here until the end of the month.

So I'm assuming at this point the K1 visa would be the best choice.

You need to be living in the Phils for 6 months for the DCF spousal visa. I thought you were currently in the Phils. How long have you been back in the States?

From your first posting I thought you were living in the Phils - "Can I file for a K1 visa for my fiancee while I work oversea's in the Philippines"

Big question is, will you have income to qualify? If not and you need a co-sponsor, the spousal visa is still the better route.

I will have income in the Philippines since I have a job lined up, but not in the United States until I come back and get a job. As for the co-sponsor, I'll have an easier time than with the K1 right?

From your first posting I thought you were living in the Phils - "Can I file for a K1 visa for my fiancee while I work oversea's in the Philippines"

The embassy has to accept a qualified co-sponsor with the I-130 spousal visa. With the K-1 fiancee visa the embassy does NOT have to accept a co-sponsor.

The I-130 can be filed while in the Philippines. Start your 6 month clock when you arrive, plan the wedding, get married, get the married recorded, you will be close to your 6 months by then. Once at the 6 month mark file the spousal visa, DCF, 60 days later ... done. You two can fly back to the states as husband and wife.

OP, do some reading in the PI regional forum to better understand the pros and cons and what is required. That will give you a much better education about the whole thing and the embassy expectations.

Hank is giving you great guidance, but do some work on your own too.
