Will your income continue from your present (at the time of the interview) job when you return to the US? If not, then you may have trouble. Manila can be difficult with joint sponsors for the K1.

Credit history does not matter. Current and continuing income does matter.

Yes, you can file it from anywhere.

Can I file for a K1 visa for my fiancee while I work oversea's in the Philippines. I will still have my home address here in the USA. Also, will my credit history affect anything ( good, bad, bankruptcy?) Any help would be great, thank you.

Yes you can file it from abroad, but the K-1 and then AOS afterwards assumes that you will be permanently residing in the US. If you will living elsewhere, then you don't need the K-1.

Well I will be working for an American company in the Philippines with a pretty high income, but when I get here I don't have plans for a job yet. I'm certain I can find a job once I get here, but for the K1 should I put my information ( address & job) in the PHilippines or USA?

When you get here, you will no longer have the job in the PI so you can not use that income on the I-134. You can not use the future income from a job you have not started. You can only use current income that will continue after you leave for the US. This is the problem Anh Map pointed out.

If you live in the Phils now and will be living, and working there, in the future, then why the K-1?

The K-1 is used to have your foreign beneficiary immigrate to the US and permanently live there.

If you merely want to visit with your fiance just to be married here, then they need a visitor visa.

The K-1 is used to have your foreign beneficiary immigrate to the US and permanently live there.

If you merely want to visit with your fiance just to be married here, then they need a visitor visa.

There is a domicile time limit that one must maintain actual residence in the US (for the K-1 holder). Do some research on that.

I heard I can have a sponsor for the I-134 instead of having an income in the US. Does anyone know if this has been successful?

On a case by case basis for Manila.

You are living in the Philippines, will need a co-sponsor as your income will end when you return to the USA? (credit history is not looked at)

GET MARRIED in the Philippines, once your marriage is recorded at NSO (PSA) file for the spousal visa (Direct Consulate Filing) right there in Manila, it takes about 60 days and the embassy HAS to accept a qualified co-sponsor (which is not the case with the K-1 fiancee visa) .

The K-1 processing time is 4-7 months at USCIS for the petition, they you have up to a month at NVC and maybe 5-8 weeks for the visa processing in Manila. Going the DCF spousal visa route is much, much SMARTER. ;):thumbs:

If I choose to do the spousal visa in the Philippines, it would take about 2 months for everything to process and for her to be able to return to the USA with me? How about the financial capability in the USA, how would I get around that? Can you explain to me a bit more of the pro's of the spousal visa as compared to the K1?

Correct, the DCF spousal visa takes about 60 days once you start. If your income does not meet requirements you will need a qualified USC co-sponsor, with the spousal visa no issues from the embassy. With the K-1 visa USEM can be a real PITA as they are not required to accept a co-sponsor.

Thank you, so I can use my parent or her parent to be a sponsor? Is there any citizenship or income requirements for a co-sponsor or they have to take any co-sponsor I choose.

Once again, I am a dual citizen born in the USA. I plan on working in the Philippines temporarily and return here with my fiancee/wife, who is a Filpiino citizen. I am qualified for to apply for the spousal visa and the full spousal visa process could be done while I'm in the Philippines? My original option was filing for a K1 while I'm still here in the USA till the end of the month.

You need to be living in the Phils for 6 months for the DCF spousal visa. I thought you were currently in the Phils. How long have you been back in the States?
