All is good it was all done under being told the wrong information from the person who commenced the first divorce. The first marriage is finished by USA standards so technically in North America I'm single and am not a polygamist. The 2nd marriage is valid in the country it was preformed and any other sharia law country. It's all sorted but thanks for the great advice from everyone.

All is not good. Were you legally married to two men at the same time? Yes. Single in the US but married in sharia law countries. That does not make sense. There is no such thing as being single in the US and legally married in another country. You are either married or not. It's like being pregnant. You can not be pregnant in the US and magically not be pregnant if you go to another country.

Not technically. Legally, you were married to two men at the same time. That makes you a bigamist. A subsequent divorce from one husband does not erase that you were legally married to two men at the same time prior. I am trying to help you by getting you to understand this so you can solve your problem. Ignore or white wash this and you are in for a world of hurt.

The OP is now divorced from husband number 1? Yes she is.

The OP needs to remarry husband number 2 to make sure that is a legally binding marriage in the eyes of the US government. According to the US government, marriage #2 was never legal. This is because the OP was not single at the time of the marriage.

Thus... once the divorce from husband #1 was finalized then she can remarry (legally) husband #2 to make that a legal marriage in the eyes of the law in the USA. The legal marriage date would be the second date. The OP MUST remarry the second husband (or divorce and remarry) to make this a legal marriage.

2nd bigamist marriage is not a valid marriage for an immigration benefit. Remarrying does not erase the 2nd marriage which is legal in the jurisdiction where the marriage occurred. Foreign marriages are legal. Just because a marriage is not eligible for an immigration benefit does not mean the US sees it as not legal system n every sense.

For the CR-1, the OP must show all prior marriages and how they were terminated. She is legally obligated to present the bigamist marriage certificate and provide evidence that is was terminated. She can not hid that marriage certificate.

Okay so she need to divorce and remarry husband 2 again.


Either way she needs to REMARRY husband number 2 after making sure any and all marriages were terminated.
