It is not clear to me if he was petitioned before by someone else or if the only other time was when he applied for the tourist visa.

Many lie on a tourist visa application that they are married and have kids in order to show stronger ties to their home country and then don't

realize that the data is cross checked with future applications. Now the past lie has ruined his future.

Your petition will likely be returned to USCIS where it will be purposely expired and the petition will be dead and closed.

If you file another K1 the same thing will happen.

If you marry and file a CR1, the same refusal will happen and the embassy may offer you a 601 waiver ( costly ) for misrepresentation.

In that case I advise consulting a very good immigration waiver attorney (not a DIY project for most), very costly but necessary.

If no waiver will be involved and they just return your future CR1 back to USCIS then you have a chance to rebut the case with evidence but it's

pretty much impossible to overcome the mess. >>>>>No K1 one will be given the chance for a USCIS rebuttal, they will NOT be reviewed.<<<<<

USCIS will then decide if your NOID/NOIR response is satisfactory or they will deny your I-130 based on fraud/misrepresentation and he will

be banned from entering the US.

I don't advice to marry because I don't think he will ever be issued a visa and in that case you will be married and living in 2 separate countries

unless you decide to move to Jordan or divorce when permanently denied.

A FOIA request could answer his previous data entries on whatever applications he may have had and confirm the whole thing but they can take a year

to answer and are often too vague.

There is no easy fix and if you move forward with this it can take years, be very costly and still come out fruitless. I am sorry.

If it was a false question to test your level of trust how could it be mentioned? if it didn't happen how could you possibly mention it?

However, I think later posts state your fiance did admit someone filed for him prior to you. What I do not understand (and I've seen this before) is why does the embassy allow people to file waivers for overstays, illegal entry, misrep, etc. and then at the second interview say "oh well now your refused because you were married previously and did not list that" "or someone filed for you before and your did not list that on your DS1160" or whatever the case may be. Why didn't they say that at the first interview?? You can't tell me they just now figured it out.

He went 3 times to interview, First time CO lady she brought it up to him and he explained to her what happen before,so she told him to tell the truth and dont hide any information and he swore on that.. ( he never told me) , the second interview other CO insisted about our relations and keep asking about it before placing him into AP, then comes his third interview yesterday and thats what happened. Why they let go of it first interview and now they are not, why not from first interview? this information has been available to them to see from day 1, so why now after we submitted everything and waited all this long.. its very overwhelming for me .. thanks for your reply...

Are consular officers allowed to lie as a tactic? That doesn't seem right. Also this story doesn't add up. Please include full details in the first post instead of making people fish for them to give the right advice. It's incredibly annoying.

Yes, CO's use this tactic if they suspect a hidden wife/kids or misrepresentation. Sometimes they are right and sometimes they are wrong.

OP's fiance has admitted his lie, so to prove he really has no wife and kids will be almost impossible and the CO was correct to zoom in on this and

refuse the visa. I don't think they just say 'oh ok we believe you lied and it's ok', nope...they will say prove it and convince us what is true.

It is easier to proof you are married than not married.

Thank you so much for your advice and helpful info, i just going to wait for their decision since it is still in AP , then after , i will take my next step, this way i will rethink this whole thing slowlyr.. its really a big mess that i never was expecting and it shocked me.. God help me

It takes time to get over the initial shock and contemplate if it's worth to take the next step with someone who is not transparent.

It will continue to say AP even if they return it, but of course it may truly be in AP for further investigation.

You should ask him to scan the 221g they probably have given him so you can see if it has been marked with misrepresentation.

You could email the consulate for an update in a months or so or make a case status inquiry through your senator just so you know

if the case has been returned or is in true AP.

You mean the 221g not 1212. If that is all that was checked then yes wait until you confirmed the location of you case

in the next few months.

Hello,

After waiting 5 month in AP, the embassy contacted my Fiance to set an intervew time and also called me to set a call time as the consular needs to talk to me. So while my Finace at his interview, the consular calls me. he started asking me if our relation is legitimate and my finace is not paying me for appliying for him and all that, I answered all question until he asked me

WHERE YOU AWARE THAT YOUR FINACE HAS BEEN MARRIED AND HAS 3 KIDS BEFORE?, i was shoked for a moment and i asked him to repeat what he asked, he goes, Your fiance submited information to the embassy before that he has been married to (here name and birthday) i felt i lost my words i didnt know what to answer him, i was shocked, i heavily answered his no, i was not aware and i did not know that. He said ok, you know you can be proscuted for false information, i said yes, i understand that, so we ended the call.

The CO went to my Fiance handling him a paper for another AP for 5 month and told him you have a bad history and we are done doing business with you today.

After my Finace left he called me complaing , first thing i asked, WHO IS (her name ) ? he was i dont know, i told him what the CO said, He sweared he has never been married before and do not have any kids and he submitted all proves to the embassy that he is single. He told me that he applied for visa before we even knew each other and who ever filled the application put this information and he did not know and did not pay attention to, so when he was intervied and the consular asked him, he told her he is not married and that information on the application is not true, so she refused him and closed the case. I asked him why you didnt tell me that before and we got into an argument about this.

When i applied for him i never knew all these information, all i knew he was deported and we filled all waivers and what ever embassy asked for. But now i feel that by hiding this im affraid he is hiding other things ( my trust has falled down)

I am really very confused now and do not know what to think, What will the embassy do? Will they take it as Fraud? Will they deny his visa and permenant bar him from entering USA? My finace explained to the Consular what happened that day but he didnt beleive him.

Any advice for us? please...

Right now you should focus on what your heart tells you and really think about it. Is he a habitual liar? even small stuff? Does he seem genuine? What kind of character is he? Kind? Selfish? How does he treat you? ......If you decide that you trust him, then with all your strength stand by his side and fight. Have no more doubts once you make a decision. okay?! You will get through this and be together soon InshaAllah.

My dear, you have a more pressing problem then the immigration process right now. You need to figure out once and firmly if you believe your fiance. I see a few others have hinted towards it all being an unfortunate misunderstanding with a falsified application and nonexistent wife and children. Right now you should focus on what your heart tells you and really think about it. Is he a habitual liar? even small stuff? Does he seem genuine? What kind of character is he? Kind? Selfish? How does he treat you? ......If you decide that you trust him, then with all your strength stand by his side and fight. Have no more doubts once you make a decision. okay?! You will get through this and be together soon InshaAllah.

Mistakes happens but lying is a choice , i was so open and said the truth to him throughout all those years been waiting for him, I did everything i can to keep this love and relationship tight and going forward not caring about no one or distance and i was willing to take it to the last. But now, i am like in front of a huge wall.. not carrying about immigration process as much as the trust between us. There is no reason for him to lie to me like that. I felt sometimes he is living in shadows and i try to understand what is going on.. Days will clear this dusty time and we will see what God will rule, Inshalla.. Thanks your your kind reply

I don't think you are disillusioned by love, which that would be a strong point for you. I can't imagine what you must be going through right now. All the time, effort and energy devoted to the future of you two, and now you find some damaging information.

Da/Ra, no matter what happened, you were not to blame. Don't let anyone in your family/friend circle make you feel like you made a poor choice by being with him during your relationship. Men can be extremely crafty. It's very possible that he does have a wife and kids and made you feel like a million bucks during your relationship. Then again, maybe he's not married at all. Neither of those situations reflect poorly on you. Take comfort in knowing that you did the best you could for the man you love(d - if things go that way in the future). Any man would be fortunate to have a woman like that; after healing, you would be a highly valued wife and companion. After things settle, your strong devotion and clear head will help you look at the entire situation. Since you have children on this side of the pond, you will know that they come first.

You didn't make a bad choice in pursuing this relationship - he made a bad choice by not telling you everything. His reason is really irrelevant. The damage is done and everything else is just emotional. I hope you continue to remain the master of your emotions during your coming year. It's okay to cry and it's okay to hurt; as long as the tears and pain don't make the decision for you. To me, I think you already know what you need to do, but no need in getting to a conclusion now. If you decide to move forward with your life without him, I don't think you will ever look back with regret.

This man has a lot of redeeming qualities and is probably a great, sweet, and awesome guy. The positive thing is that you will be able to find another great and genuine guy in time. You did the right thing, Da/Ra. I think you will be able to make the right decision for you and your family in the coming months. (F)

thanks for your valuable words , you are right, i always stood up strong in my life whenever things turned to storms. I will sit and wait for now and take a deeep breath and let time heal as it always did to me. I will not let go of him because i never loved a man like i love him, but i am affraid this damage will ban him from comming to USA and this will put an end to our life together as i can not leave everything behind and go live in a place where i have no one to support me when i need to. I pray to god things turns out good and not as damaging as i am thinking or learning from others.

If you decide you can't be married to him, you should not keep a 'friendship' and you two should end the relationship. Many people are still friends with their ex and will even jeopardize a new relationship to maintain this friendship (by trying to force the new partner to accept the friendship by calling them insecure, jealous, or immature). A man and a woman that had an intimate/romantic/dedicated relationship that can no longer continue that relationship, no matter the reason, should not continue the relationship. If they do, then nothing has changed, they are still continuing a relationship.

They may tell themselves that they are friends and not really in a relationship and see other people, but that's a falsehood and it's selfish. You love him and not ready to end it. That's understandable. If you keep it, it's a romantic relationship, not a friendship. Letting go of someone is not negative - sometimes it's the most selfless thing you can do. Don't "keep" him unless it's the healthiest thing to do. If you two can't be together as man and wife, you cannot expect him to forego pursuing a marriage with another woman and you cannot expect his wife to accept you as the "friend" when really you are another woman in the relationship. You cannot expect your new husband (when/if you get to that point) to accept some dude Skyping with you in your bedroom.

I hope you aren't reading this and feeling like I'm trying to berate you. I just want to express to you that sometimes the most loving thing you can do for someone is to let them go. That's true even if you and/or they don't want to let the relationship go. You can't prepare yourself for a new relationship while being in an old one. Men may think they can, but that's because they are dummies and the ones that do are using women.

If he is indeed married or was married, I would be wary, especially if he divorced recently within the last 2 years.

A common path some people take to get US citizenship for them and their families is to fail the K-1 (this builds a false sense of security, and a more willingness to pursue the relationship further), and marry in their home country. Once married, they file spousal visa and wait until they get their US citizenship. Once naturalized in 3 years they divorce the US Citizen and petition their former wife and kids over to the USA.

I'm not saying this is your case, but it's something to think about and be aware of these days.
