We had our AOS appointment in early December 2006. At the time of our appointmen, the lady who interviewed us said that my husband's application was approved but the FBI name check was pending. She said that there was no timeline for this to be released....It is really getting to us since my husbnd wants to travel back to Jamaica and visit his familiy and kids...The AP is no guarantee that he will be allowed re-entry so we are skepticl about traveling without the greencard. Anyone else experiencing this delay???? How long has it been for most people on average???

We had our interview in early December, and are stuck in FBI namecheck stage.

If your hubby was never out of status then AP should be good enough to get him back after a trip back to his home country. But if he has ever been out of status it is best to consult with a good immigration attorney before traveling, to be on the safe side.

Good luck!

there are so many of us in the same boat. we have been waiting over a year ourselves. we felt the same as u and just waited and waited for the green card because we were afraid of AP also but after a while my husband couldnt wait anymore. his parents were asking him every time he talked to them when is he coming home. his mom started making guilt trips on him saying...i will die before i see u again. so he gave in and got AP. he came back to the country with no problems at all.

u could be in for a long wait.

I don't know if I am or not. I filed AOS over 4 months ago and have not heard anything concrete since it was transferred to CSC mid november. I might give them a call to see if I can get some misinformation.

My hubby and I delayed filing for AOS for a year, and used AP at Christmas time without any problems while our AOS had been pending 4 months.

Feel free to check with an immigration lawyer as advised above, but also check out the 'working and traveling' part of the forum for success stories on people using AP. We got quite a few before we set off as we needed reassurances too with regards to the non-guaranteed return to the USA clause.

Best wishes
