Wife coming to US as a visitor? Should she risk it?

Hello,

My wife and I got married in her home country of Poland last week. We decided that I was just going to come back home and file the I-130 /I-129f(K-3)and wait to see what happens, but after just getting married we can't imagine being apart now. I am still in Poland and have a few questions before I return.

My wife has a visitor's visa B-1/B-2. Can she return with me to the US as a visitor? What would be the best way so as not to have any problems at the US POE? Should she apply for her new passport with her married name or travel with her current passport with the visitor's visa? Or should she apply for her new passport and travel with her new passport and old passport(The one with the B-2 Visa)? Bear in mind that I still didn't file the I-130 since I am still not in the US.

Would it be easier for her to enter prior to me filing the I-130 with her old passport? Or should I return by myself, file the I-130 then she can follow with her new passport and old one(the one with the B-2 visa) a week later?

We plan to be completely honest and would answer every question by stating we are married to the POE officials. Her intent would ONLY be to visit and then return to Poland once our K-3 or I-130 are approved so she can take care of the rest of the odds and ends. I know our other option is to just wait for the I-130, but if this is a possibilty please let me know!! I appreciate any and all responses:-)

She may still be turned away at the POE and denied entry. She may not. None of us here have any way of knowing what will happen.

*legally* she should be allowed to visit the US if she has the tourist visa. However, now her situation has changed and she's married to a USC, which makes her ties to home country less tenuous than her ties to the US.

If you don't mind losing the airfare cost, have her bring along lots and lots of proof of ties to Poland. Like a letter from her employer stating she is on approved vacation leave and expected back on a specific date. Copies of her mortgage or rental agreement on her home...anything that will "prove" she must return to Poland.

Still, all of that is no guarantee they will allow her to enter the US.

Timeline

On my return from England two weeks ago, through Chicago Ohare, I asked the person who checked my passport what my wife, a UKC, needed to do or have to get into the US to visit while waiting for her green card. The young lady was very nice and even went and checked with her supervisor even though they were very busy. The answer was first be up front that you are in the K-3 process and that you are coming to visit your spouse, do not play coy and say you are just visiting. Secondly have a return ticket and third do give them any attitude. It never hurts to have plenty of proof you are going back but she was very emphatic about being upfront with them and not giving them what she described as attitude.

thats true reba thr is no guarentee

thts why i am not travelling to us with a visitors visa

despite i have an important exam coming along :(

its so sick

sometimes it feels like they r ruining career

n sometimes i feel like it was better not to be married n get stuck like this n wasting my entire one year
