U belong from a Muslim country and u also Muslim, u won't able to get same sex fiancé visa.

You REALLY should NOT Be giving incorrect advise (not sure what your motives are for doing this but I can guess)!!

YES you CAN get a K1 visa because it is based on US Law and not Turkish or any other country law.

I say this because my partner is from a country that does not have same sex marriages too and he was approved!!

You are 100% on track so dont worry. Just answer the questions honestly and truthfully and you will be fine...

Not true. The CO follow the USA law....AND THE LAW IS SAME SEX MARRIAGE IS LEGAL IN THE USA

It's not the same-sex relationship that is the red flag in this case, I would say it's the age difference.

But like was mentioned early, as long as you explain everything and have documentation of a legitimate relationship it shouldn't be an issue.

The user was just saying it depends on your interviewer because they are going to have to use their discretion when making the final decision.

I am thinking the age difference isn't going to make as much difference as some think. It's commonly waved about as a red flag, as is seen in some cultures where it is unusual for a man to marry an older woman, past childbearing age. I don't think that's going to be an issue here somehow.

His intentions were very clear. He is right about that in Muslim Countries same sex marriage couples face very hard circumstances usually so based on this info he probably was right to think he might not get the visa. And Yes CO has no influence of what ever country a sex couple is applying from he just follow American Law. So he is pretty much on the safe side.

I don't think anyone here claimed that it would be denied for this reason. Most just warned him that they will ask about it, which they might. It's happened to my aunt and her fiancé was from a low-fraud country.

Congrats to you and your husband though.

I'm not sure why so many folk like to say "well it happened to me" or "well it didn't happen to me" as proof that this will be the case for everyone. Some posters are merely reminding the young man that there is some subjectivity in this process. All you can do is prepare your case and take comfort in knowing that a proven bonafide relationship should prevail.

Stay confident for your love. Iam also Muslim and my fiance is 62, Iam 25. Many people willsay different things, But focus on ur love and prove it. We got approved in 2 months only! Samesex fiance visa. focus only on Positive side and One thing I will tell you! if u r really in Love then nothing can stop you! US embassy is the one of most Gay friendly embassy in the world and all workers are there so nice, Polite, Friendly and kind people. Belive on God and only God can gauge! Remeber LOve is LOve and prove that to everyone!

Hello everybody,

I am 25 and my fiance is 50 we have been dating for 4 years almost, we have a significant age differences but its love and I am deeply in love with him, my family doesnt know about my relationship because of religion things and other stuff, during this 4 years we have met in person 4 times I spent a summer in USA and he visited me 3 times last one was in August, we applied for fiance visa back in February and I have a scheduled interview on 3 of December, I have sent my file with lots of proofs of our relationship and other all documents they want, I am so nervous with the interview and I want to see what you guys think about how it will be, what do you think our chances are, in my country Same-sex marriage is not legal, so I dont have an option to marry here either.

Another question: would me being in USA on another visa help me, I also have SSN, would these things make interview easier?

There should be no discrimination for age difference. If you have a solid petition with lots of proof. then you should be fine. I am 20 years older than my mate although heterosexual relationship, it should not play a factor. Is your petitioner from a state that honors same sex marriage? that would be the only other issue. but you should be fine. good luck.

Same sex marriage is legal country-wide now (as of the Supreme Court decision this June), regardless of what the states (or Kentucky country clerks) want.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

i said that you will be interviewed in embassy in a country that is mostly muslim / if the embassy hires locals for language skills to do interviews as they do in Ecuador, and you are interviewed by a devote muslim, then what?

K 1 is always hard to get in some countries to begin with,

i am not judging you / i am stating this only as i had a friend trying for K 1 in to an Algerian man and they were turned down as she said she will not convert

it is not legal in US to discriminate for sex, religion or race, but proving a case is not easy

i wish you well as we all do here but the road to a visa is hard
