I-864 help needed USC living abroad!! Plzzz :)

Hi everyone!


We have started filling out the I-864 form and I'm wondering if you can help us fill it out correctly? I'm Swedish, my husband is American, we are both living in Sweden. He is dyslexic so I'm in charge of reading and writing and I'm just going bananas because the form is so user unfriendly :P We have two sponsors because we want to make sure that NVC won't have anyting to complain about. Each individual earns enough so we don't really need two but better safe than sorry. One is my mother-in-laws husband and the other is a friend of the family. Both of them will fill out their own I-864 and send us all the required papers.



What I'm confused about is how do WE fill out the form? Can we leave any fields blank or do we put n/a? Just want to make sure since NVC says one thing and I read different things over here.



Part 6:1-2 = Should we put him as unemployed and income $0 because he has not made money in the US?



Part 6:3-8 = "Income you are using from any other person who has counted in your household size" Leave it blank / n/a?



Part 6:15 = Do we put $0 or do we put the amount our sponsors earn?



Part 6:16 = I thought sponsors had to fill out I-864 and not I-864A since they are not household members? So just leave that one blank or n/a? :o



Part 7:1-10 = Do we put our savings on there or do we combine that with our sponsors?



I bet you I have more questions but these are the ones we are stuck at right now. Thank you bunches!! :)

The US citizen is taxed on worldwide income and must file tax returns no matter where they live or work. So your US citizen spouse must show his last 3 year's US tax returns or submit a signed statement as to why he was not required to file. If he was required to file, but didn't, then those returns must be filed and IRS transcripts submitted. See the form I-864 instructions.

Filing a return and owing tax are two separate things.

The joint sponsor completes the I-864 and supplies all required evidence of filed tax returns along with current and continuing income (unless the sponsor is self employed). If the joint sponsor is married (your MIL), their spouse should complete an I-864A, especially if they file joint tax returns.

You don't combine anything (income, savings) with the joint sponsors. Their income or assets must stand alone as sufficient.

Thank you for your reply! We will be writing a letter explaining that he didn't earn money in the US and therefore has not filed any taxes. Since the US and Sweden has a contract that double taxing won't happen since he earns less than $99000 we can take care of the taxes when we make it back home :)

You didn't read enough. A US citizen who earns more than $10,150 (in some instances as low as $4000) must file a tax return even if there is no tax owed. It is NOT what is earned in the US, it is GLOBAL earnings.

If he has not filed tax returns in the most recent 3 tax years then he must do so and submit IRS tax transcripts along with his I-864. Not submitting those tax transcipts will result in an RFE which stops the processing until you supply the needed documents/information.

Oh ok then I misunderstood it, I thought that if you earn less than $99000 you don't have to file it. Thanks again for pointing it out. I'll put my husband to work tonight :)

Does anyone have any tips on how to reply the rest of my questions?

Part 6:1-2 = Should we put him as unemployed and income $0 because he has not made money in the US? Correct me if I'm wrong but isn't it that foregin earnings don't count, especially if they will end when we leave Sweden?
