Hi! We are military family. We applied for I-751 removing condition of residence thru marrieqge and with that is the fee waiver for 150% poverty.

My question is as a family we recieve a so called BAH not is not taxable income. If the 150% federal poverty guidelines will base in our income return tax we are below the guidelines. But since im confuse if they will include the BAH that we are recieving since we are living off base. Family of five. Me and my two daughter are applying for I 751 which is a total of $1755. We really dont have money and living pay check to paycheck,

If we only knew about paying it again to the immigration we are not coming here in the US in not completing the two years anniversary being together but since my husband got an orders back in san diego from Atsugui Japan. We have to be here also and live with him.

Do you guys think we are qualified for 150% poverty guidelines or any consideration about it? I cant sleep anymore and our green card will expire this coming december.

Military is 125%

We are still below the 125% if only his base pay will be base not including the BAH. Because all i know there is some governement agency they include the BaH. Like for example we are approve to SNAP if we they will not include the BaH we are recieving. So it was confusing to us. I called the uscis regarding this but th just said if you are below then you more likely be approve but they dont know about the BAH.

I'm military and don't really know if they count BAH or BAS....

It's a good question, sorry I couldn't help....just wanted to point out it's 125 for military thinking that might help.
