Hello,

Im so happy I found this website!! So much good information.

I am Canadian, residing in Montreal, Quebec. I got engaged to this wonderful man from Colorado just a few weeks ago and we are really excited about the engagement and wedding.

I've been reading up on Fiancee Visas and Immigration through Relative(Spouse).

Im really curious as to what the best option is and I really could use some insight. We plan on getting married in Montreal, hopefully something like September or October.

Now we've heard we should go with the Fiance visa, but Im not so sure. And if we go for Spousal Visa, does that mean that I can't move there until the whole immigration process is done ?

Thanks in advance and I hope this is in the right forum

Filed: K-1 Visa Country: Canada
Timeline

Welcome to VJ.

If you are planning on getting married in Montreal, you will not be able to apply for the K-1 Visa (Fiance Visa). With a fiance visa, you must enter the U.S., and marry in the U.S. within 90 days of your entry.

If you marry outside the U.S., then you will need to apply for either the K-3 Visa or the CR-1/IR-1 Visa.

You can read all about all the different types of visas, and the paperwork associated with each of them, in the "Guides" and "Visa FAQ" sections at the top of the VJ page.

Whichever visa you apply for, you can visit the U.S. to see your fiance/husband for up to 6 months. You must return to Canada for the visa interview. When you enter the U.S., you will need proof of ties to Canada, such as lease/mortgage documents, your most recent pay stubs, a letter from your employer stating the date you are expected back at work, etc. to show that you intend to return to Canada after your "visit" to the U.S.

Good luck with your decision on which visa to pursue and also for a speedy process.

Also if you are set on getting married in Montreal, that might now work too well with the K1 and a September date. You cant get married before you enter the US on the K1. Everyone here usually recommends with the K1 not to plan anything until you have the visa in hand. You may be able to have an unofficial ceremony but make sure it isnt referred to as a wedding or him being your spouse.

So basically, getting married in Montreal eliminates the Fiance Visa option if I understand correctly.

Any other option, there's no way to permanently move to the States as soon as Im married, even if I don't work until a Visa is issued ? And if we were to be married say in September, how long would I be apart from my husband ? 2-3 months, or something more like a year ? Meaning I should strongly consider getting married in the States so that we can do the Fiancee Visa.

There's just so much information that it's difficult to see which one is the best option. It's a bit overwhelming really, lol. I just really want to be able to plan a date and a wedding, but seems impossible without knowing what kind of timeline we are looking at with the immigration stuff.

Thanks for all the help, it is really much appreciated
