Hi, I am fairly new to this site and can't seem to find a conversation that solves my issue. May be somebody can help me. Thanks in advance!

We have received NOA1 and NOA2 for the I-130 and are waiting for further instructions.

My question is about the Affidavit of Support. My husband is a US citizen and we have lived abroad together for 5 years. He keeps his permanent residence in the US (his hometown house) and has been filing for taxes during all this time. He is working here at the moment and will be working until the moment everything goes through with immigration and we can leave, but when we get to the US, he does not want to find a job right away because he will be finishing a degree. We have enough savings here and in the US to cover for the minimum but I am concerned about what papers to submit and how to fill out the form.

Are savings considered as assets? Also, in the form for Affidavit, all the employment information is related to his current job abroad, right?

Hopefully somebody can give me some guiding information!

Hi,

My husband and I were in a similar situation to yours. Savings are considered assets - there is a box in the Asset part of the form that specifically relates to savings and checking accounts. And yes, his employment information would be related to his current job abroad.

However, keep in mind that because he lives abroad with you, he will need to establish proof of US domicile. You mentioned that he has a permanent US address but read the I864 instructions to see all the ways he can prove domicile. My husband was accepted to grad school in the States so that was easy for us. In your case, your husband would have to prove he would be returning before or at the same time as your entry to America.

December 5, 2015 - Received Conditional Green Card in mail

 

Removal of Conditions:

August 28, 2017 - Mailed I-751 package with USPS to VSC

August 30, 2017 - Per USPS tracking, package was delivered to St. Albans, VT

September 7, 2017 - VSC cashed check

September 11, 2017 - Received NOA (receipt date of Aug 31)

September 23, 2017 - I-797C Received (receipt date of Sept 15)

October 6, 2017 - Biometrics Appointment

August 13, 2018 - I-797 Received (receipt date of August 6) extending status for 18 months

November 13, 2018 - I-751 Approval

November 21, 2018 - New 10-Year Green Card In Hand

We filed on assets only too. My husband planned on getting a job right away, but only current income counts (and it actually ended up taking him several months to get a job). Savings definitely count as assets! Provide bank account statements and such to prove it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The assets must equal 3 times the income amount. For a household of 2 that is (3x $19,912). You would need to show that you've held that money for a significant amount of time (as opposed to someone loaning you the money to drop into an account in order to satisfy the I-864).

Your husband's income from abroad does not count unless it will continue once he's in the US. I was employed in Japan but I put my income on the form as $0. If you mark that you are employed - even with an income of 0 US dollars and tax information showing foreign income exclusion - you might receive a checklist asking for proof of his employment, so either do not write in his foreign employment OR go ahead and include a letter stating that his employment is with an overseas entity and it will not continue once he leaves Japan.

To prove domicile, I had my mother write a letter stating that we intended to live with my parents for the time being. I think I also scanned a membership card to somewhere-or-other and a recent statement from my bank in the US. We had no questions about that.

So: current job, taxes until now (which are based on that job), savings are assets, proof of domicile (dad's letter and others) and cover letter saying that he will quit once we move. Awesome!
