Where in the instructions does it state you cannot use your home unless you own more than one? That you can only use a second vehicle, yes, but not that you may only use a second property.

Primary homes would be disallowed under this provision in the instructions; the key words in bold and red.

Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included.

Liquidation of a primary home in the event of the terms of the I-864 not being met would constitute a considerable and undue hardship to the owner.

I'll grant that the instructions should be more clear about this issue.

September 10, 2011: Emailed AOS package

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The current income is the most important thing. If she makes $30,000 a year in income, then that is enough for a household of 3. She needs to provide proof of that income, and then she can add in her assets on top of the income, if she wishes. I wouldn't rely on just a home value alone. They will look at the overall totality of the situation to decide if you will become a public charge or not.

I know it states that all assets need to be liquidated without hardship, but it never states in the instructions that you may not use the value of a home unless you own more than one property. It only states that outright about automobiles. If they only ever allowed the value of property if it was not the only one you owned, then they would add that stipulation along with the one about cars.

Each case is different. Someone might own a home/property that has a high value, and therefore selling it off and downsizing to a cheaper property would not be a considerable hardship. And as I already told the OP in this thread, I wouldn't rely on the house value alone, unless of course the OP's joint sponsor has property with a very high appraisal/net value. They always like to see ongoing, stable income above anything else.

You need to know the household size. She will fill that out on her I-864. Her household size is herself, any spouse, any minor children, anyone else she claims as a dependent on her taxes, plus you, the intending immigrant. I gave him a figure for JUST assets. 5x the poverty guidelines for 3 people (joint sponsor, spouse, and beneficiary.) He said they weren't working..

thank you very much for yoir time,i will ask for household size and i pray that income should be enough for this process as this is really drive me crazy as hell,getting sponsor is not that easy as some people thinking negative as one might sue them in the future

I am been searching for a sponsor over a while now as my petition has gotten to the stage of support,the yearly earning of my cosponsor in 2012 and 2013 are good but fall short in 2014 due to sickness and it is above the poverty guildline in 2015 but right now she ve not file for her tax return,she have pay stubs and letter from employer showing that she made above the poverty guildline ,she also ve cash in the bank and some little asset,please i need an advice in what to do and what to submit ,can we use bank acciunt statement to support the 2014 that she fall short or what exactly can will do with the asset and cash in the bank and the rest of tax return,she also recieve foster income from state.thanks as i hope for you reply

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

My wife is the petitioner and she ve no income other than SSI,we have her cousin who is our cosponsor but her income fall short and we have to add other side income without tax return but we submited a fall in income tax return which NVC rejected,now my wife want to use her cousin with the daughter of this her cousin who is have a seperate tax return,can we use my wife cousin and the daughter of this her cousin as our cosponsor,meaning 2 other cosponsors with my wife?
