to make a letter or not?

hi everyone... we are just waiting for the day of our interview... we are hoping that everything will go well..

i just wanna make sure that everything is complete now... if you don't mind me asking for your help guys...... my USC fiance isn't making much money for the past 2 yrs & was not required to file taxes at that time... does my USC fiance still need to write a letter of explanation why he didn't file any taxes for the past years? or he doesn't need to? he is coming with me to the interview by the way...

According to the I-134 form, you only need to show tax returns if you are self employed. For those who are not self employed, a letter from his/her employer is enough. I would double check with the embassy though, they might require more proof.

If your fiancee cannot meet the minimum requriements, then your fiancee will need a co-sponsor.

Basically past earning power doesnt matter, what matters what you currently make and what you will make in the future or wether or not you have enough assets to meet the requriement for 3 years.

Hi Faye! Good luck on your interview. The thing I am wondering is what your packet asked for? If your fiance is above the poverty line for his 2006 income, and/or currently earning above the poverty guidelines, and you have only been asked for last year's tax return just give them that. Did he file a return for 2006?

If they asked for the last 3 year's returns and he doesn't have them because he didn't file, then you will likely want a letter from the IRS indicating he was ok not filing taxes based on his 2004 and 2005 income level. He may also be able to prove he did not need to file by searching irs.gov and finding the income level rules for tax filers.

Probably no letter will be needed, for the reasons others have stated. Make sure you have recent paystubs and bank statements, though.

However it wouldn't hurt to have him compose a letter and print out the rules from IRS website (about income requirements for filing) just for your peace of mind and just in case someone actually asks about it at the interview.
