Quick synopsis. I am a U.S. Citizen married. I married a Philippines citizen while she was in the U.S. She is currently in the Philippines with my two step-children. I am petitioning for all 3.

I make 26k a year, poverty guidelines for household of 4 is 30,312. Therefore, I sent a separate i864 from a cosponsor that makes 200k.

I received i864 corrections back for all 3 intending immigrants. Both i864 used my wife as the primary immigrant, and the children as the ones coming with.

1. Correction 1 was "Immigrants you are sponsoring does now allow accompanting family members. So I guess my first correction needs to be my cosponsor and me need to fill out 3 identical i864s, just change the name for the primary immigrant?

2. Correction 2 was signature must be original. I thought I was supposed to send copies and give originals during the interview? Is this not the case?

3. Correction 3 is I used 2013 taxes for my cosponsors taxes. I figured 2013, 2012, 2011 taxes would suffice since they make over 200k each year; obviously it would be around the same for 2014. The thing NVC sent back says to attach a letter saying they didn't file. So what does than entail? Just have him write a letter saying he didn't file? I know most people believe April 15th is the deadline unless an extension is given to October. But for most Americans, that is not the case. I should know I just graduated with an L.L.M. in taxation. If one receives a refund, the deadline is 3 years.... As the IRS Publication, "If you were due a refund but you did not file a return, you generally must file within 3 years from the date the return was due."

4. Not part of the thing sent by NVC, but a separate question. If we do have to send separate i864s, then why did I need a cosponsor in the first place. My household size for my wife would have been 1 for her, 1 for me. It doesn't say stepchildren counts as any so that would be 0. I haven't sponsored any other people who are NOW lawful permanent residents so my family size would be 2, way under the poverty guidelines. For her children, it would be 1 for me, 1 for being married, 1 for her child. Poverty guidelines would be 3, and I would be over again. So why the need for the cosponsor in the first place?

No matter what degree you hold, the requirements for the I-864 are what matters.

That means that the sponsor must show the most recent (3) year's tax returns and also proof of current and continuing income (unless they are self employed- then line 22 of the most recent year's form 1040 is the amount evaluated). Typically current and continuing income evidence is a few recent paystubs along with an employer letter showing position, pay rate, and length of employment.

 Send the missing or corrected items to the applicant so he or she can take them to the visa interview.

 Send the missing or corrected items to the National Visa Center (NVC) and include a copy of the

Case Number Barcode Cover Sheet. Clearly write your on the

upper right-hand corner of every document you send. After you email or mail the requested

information, allow us 30 days to review your response. When we complete our review, we will send

you information about the next processing step.

We reviewed your I-864, I-864EZ, I-864W or I-864A Affidavit of Support form and supporting financial

documents. We found that you didn't provide all the necessary supporting documents or you had

incomplete information or you missed some questions on the Affidavit of Support form(s).

On the attached Affidavit of Support checklist, we have put an "X" by each item you need to correct. Go

to the Department of State's website at http://nvc.state.gov/aosandfollowthe instructions for the

Affidavit of Support form(s). From there, you can fill out a new form, sign, and send the form(s) to the

NVC. We require an Affidavit of Support form for each case regardless of your income level.

Your case is on hold until you send us the items we need. When you return the documents and

completed Affidavit of Support form(s) to the NVC, please make sure that the documents are in the

correct order, as stated in the I-864 Important Notice instructions.

When responding to the National Visa Center, please include the bar code sheet that came with this

letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar

code sheet should be placed on top of all documents being submitted for this case and mailed to the

address provided.

The National Visa Center (NVC) recently reviewed your I-864 Affidavit of Support form. The

Affidavit of Support form had one or more sections with missing or incorrect information or

was missing required supporting documents, or both.

Please review the instructions below to complete a new Affidavit of Support form or to obtain

the missing supporting documents. Send the corrected Affidavit of Support form or original

documents that are missing to the principal applicant so he or she can take them to the

immigrant visa interview. You should also send photocopies of the Affidavit of Support form

to the principal applicant for each traveling family member to take to the visa interview.

Failure to take the original documents and copies for each traveling family member to the visa

interview can cause processing delays. The Consular Officer will review the corrected form

and documents at the time of the interview.

You do not need to contact the NVC at this time. Also, do not send an updated I-864 Affidavit

This checklist confused me .. They give me two instruction which one I want to do ... Which form submit nvc or take to interview

This checklist confused me .. They give me two instruction which one I want to do ... Which form submit nvc or take to interview

you have to correct the AOS one from you and one i guess you have co- sponsor..just correct the things they mentioned and send it to them
