B1 Tourists Visa From Ukraine

My wife is adjusting from k1 visa still waiting for her final approval to receive her green card, she wants her daughter to visit us when she is off from school in Jan. 2016, has anyone been approved recently for their college aged child to visit them in the US for a B1 visa from Ukraine ?

We support the daughter in Ukraine, so she had very little assets of her own.

It was said above "college aged"(18-22 approximately)

My answer:

Could be a hit or miss, but most likely have higher chances. It is worth a try!!!(the only investment is interview fee).

It could be difficult for her daughter to get a visitor visa as a young single woman.

If her mother decides to petition for her, it could be 7-8 years for a visa.

If the daughter gets a K-2, she can come to the US and get a green card. She can get a Re-Entry Permit allowing her to stay outside the US for up to 2 years.

You may want to consider the K-2 route so she can study abroad and then come to the US afterwards, rather than wait for 7-8n years.

She has almost 0 chance of getting a tourist visa. She has no assets in Ukraine, has immediate family in the US, and is very young. All factors work against her in a big way. According to law, the officer interviewing her has to be extremely confident that she will return to Ukraine, it's going to be extremely hard to prove that with your circumstances. If she would be married and have a family of her own, then it's possible. Otherwise there's pretty much no chance.

You never know until you try... My friend's sister got her B1/B2 visa approval at the third try! She is 20, not married, and she has very little assets of her own also. The first two tries she was asked a lot of questions, having really a hard time during interviews. And got denial..

But at the third time her visa was approved without any issues at all - most questions were about her older sister, who is in the US, and who was K1 Adjustment Pending at that time...
So, i would just keep trying... :)

Also, if there is any way to get K2 visa?.. I mean if daughter was mentioned in I129F petition and 1 year has not passed since K1 was obtained.. ???

If there is still an opportunity for K2 visa to be issued, probably it would be a better way. I understand she is at college, but usually it is possible to take so called "gap year/academic vacation " or to study online.. so she could come here, to look around, filing AOS at the same time. She will receive her EAD card or she could apply for re-entry permit if she decides to come back for college. .

It K2 is impossible, as I've said before - I would keep trying to obtain B1/B2..

.. It is hard to be apart with your kid - it doesn't matter how old he/she is.. So whatever you, guys, decide, - I wish you all the best!!!
