I've looked into this myself and the answer YEEESSSS! A CR1 visa holder can automatically become a (conditional) resident upon entry. You may leave anytime you want but also you may not want to be gone out of the US for more than 6 - 12 months - this can lead to some sort of suspicion.

Correction: A CR1 VISA HOLDER AUTOMATICALLY BECOMES A (CONDTIONAL) RESIDENT UPON ENTRY.. Disregard the CAN

I'm still waiting for my case number. No letter from NVC yet ;/ my case was received on October 19th. I called them this week again and they said it takes 42 days. So frustrating:(

Hi, did you received case number yet? Mine was approved by uscis on oct 7 and oct 27 NVC recieved it, after that i called every and until today I haven't got my case number by NVC. Still waiting.....

mine took a little over two weeks. You should be getting your case number soon!

I was lucky to get mine unlocked after 12 days, by calling at night and receiving a different agent than usual.

Thanks I just called and very pleasant lady told me that administration is still working on the case so she is unable to do it for me.

So we called and the customer representative confirmed that we got our case complete! Our scan date was October 13th.

It takes 2 Weeks for USCIS to send the file to NVC and once NVC reserved it it take 2+ weeks to enter in the system and generate the case number, I am still waiting for case number to be generated, already 2+ weeks.

So our scan date was 10/9 and yesterday I called and questioned about the status since it is now past the 30 days. The clerk said she would give our file to a supervisor to find out what is taking so long and since it was the 30th day something would happen prior to end of day. I called back today and was scolded since I called yesterday and they show record of it :). But nothing yet no CC or checklist.

9/23 Rec'd by NVC

10/1 Case # and IIN from NVC by phone

10/1 DS-261 complete

10/2 AOS bill paid (status in progress)

Its been 2 weeks I haven't got my case number, i am calling NVC everyday since last 2 weeks but they have same answer that my file came into nvc system on 26th october and it can take upto 42 days to generate case number and invoice number for first payment. Very frustrated....... Any comments???

I know that in the FAQ's of the DS-260 is says that all answers must be in English. But, should I really translate the address and the name of my high school, university and current employers name?? The name in Spanish is the legal title of the institutions.
