K1 Fiance petition after canceling a previous one.

Hello, recently I canceled a k1 fiance petition for someone who I had broken up with quite a while ago. We had never made it out of the TSC, and the cancellation request went through successfully. Now on the I-129F that I am filling out for the person I truly want to marry it says #14- Have you ever filed for this or any other alien fiance or husband/wife before? Even know I canceled it in time before it got out of TSC do I still have to say yes? If saying Yes, I do not need to apply for a waiver because it was never approved petition am i right?

I would highly suggest a relationship timeline. So they can see where the relationship started and ended. Cuz on paper filing a month after you just cancelled doesn't look good Nor does knowing someone previous and now you ended one and went back to them. It questions your judgement if you know what you want (thinking like a CO so please don't be offended.

* Wait several months before you file, it is too soon.

* Uganda is not as bad as some other African countries but it is still difficult to get approved there.

* Front load the petition (use the VJ search bar on existing threads about front loading).

* Include a waiver request for multiple filings, even though you may not need it, some IO's will RFE for it, it's just a small paragraph you

write on a sheet of paper, no special form.

* Yes, you fill out that you filed before and you write the results of that filing in the next space with date and number.

* Create a relationship timeline letter explaining your previous petition and why it did not work and how you met and fell in love with your current

fiance. I repeat : wait to file ! It is better to wait 6 months now rather than being denied and having to start all over again and add another year.

This thing is way too fresh with too short of a gap. Not credible enough for Uganda.

* Visit again and collect more evidence to prove a bona fide relationship before filing.

* Be on the premises for the interview.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

You may need a waiver since you just filed. Front load your application/submission. I've read many african consulates are difficult so expect a lot of scrutiny.

Here's my two cents. I would wait to file. In fact I wouldn't think about filing before 2016 a year after I cancelled the last one. This would give me more face to face time,which it seems you can afford, to better front load and it would also allow me to avoid the intense scrutiny of filing two K1s back to back. Not doubting your love but it just doesn't look good on paper as a timeline no matter how you slice it. Your explanation could potentially make matters worse. Your judgement would be highly questioned and the interviewer at the embassy might feel a need to save you from yourself. Is your fiancé from the same country? Is she aware of your ex fiancé and the circumstances? Good luck and take your time.

I really don't want to wait 6 months just to submit a petition that I already know is going to be going in. If we do send it in now but front load with a bunch of evidence, and it gets denied, would getting married and having her come on a CR-1 be easy enough?

One last thing to consider is that right now I am living in Connecticut which means my paperwork goes to TSC. I do have family in Nberaska and am looking to relocate within the next 5-6 months. Its my understanding that Nebraska goes to CSC. If this is the case it may look better to wait and as long as I am in Nebraska in like 6 months it would be the same time frame as the dreaded wait list at TSC???? Can anyone confirm nebraska goes to CSC?

All petitions are currently being routed to CSC no matter which state you live in.

Yes! Currently K1s are processed quite quickly. But this is the government we're talking about after all. If you do decide to go ahead please be sure to attend the interview and be prepared for both of you to be grilled with a well done char. Time is your friend.

It sounds like the 'relationship' with your new fiance overlaps the 'relationship' with your old fiance. I can imagine some tough interview questions about how serious the filing for your last I-129 was, and also how serious you are about the current filing. Good luck with that.

You might help your case by building, and documenting, a relationship that occurs after terminating the last filing. Doing this will, of course, take time.

You can't bank o were petitions go now or 6 months from ow. It's forever changing. CSC is getting every bodies back log how log you think that will keep up. Nebraska is sending petitions now to the new service center in Virginia. Good luck with that. Fast or slow.Fast lane is not where you want to be.

Explain the why we broke up is not a good idea and has nothing to do with back to back filings and will onl speak negative or positive to your character and your choices. So trend lightly on how much information you want to tell.

Your fiance is the one tat needs to be update and know all the facts since she'll be the one interviewed and I am sure questioned about the ex and did you know this that and the other. As well as were you talking to each other while he was engaged to another? How often? what dd you talk about? See how it all looks not real good.
