K1 Fiance petition after canceling a previous one.

Hello, recently I canceled a k1 fiance petition for someone who I had broken up with quite a while ago. We had never made it out of the TSC, and the cancellation request went through successfully. Now on the I-129F that I am filling out for the person I truly want to marry it says #14- Have you ever filed for this or any other alien fiance or husband/wife before? Even know I canceled it in time before it got out of TSC do I still have to say yes? If saying Yes, I do not need to apply for a waiver because it was never approved petition am i right?

Filed in march of 2015 canceled october, and now trying to submit for who I want to spend forever with.

would it be better to instead get married there first?

I had stupidly not realized the proper process to cancel so it looks a lot worse if your looking at when it was actually canceled to when the relationship actually ended.

Semantics aside, you filed in March and just canceled in Oct 2015? Today is halloween..and you're wanting to file for yet someone else already?

Broke up 'quite a while ago'...struggling to understand this time flow. I'm only suggesting as I think any if this got that far, the Consulate should / could surely ask this.

Me and my current fiance have been friends since September of 2014. We talked daily as friends when I had submitted my petition for my ex fiance i had reservations about it and didn't feel comfortable I should have listened to my gut instincts. As I began to confide more and more in my fiance that i have now i realized that me and her had a lot more in common that she wasnt out to use me as my ex fiance had been and that I was waking up everyday looking forward to speaking with my now current fiance instead of who I was with. Therefore I called the whole thing off with my ex and took some time to get myself together. I then went and visited my fiance and she stayed with me while I was in her country. Things went extremely well and based on the friendship and knowing each other from the entire year previously I knew I wanted to propose and so I did.

Its a good sign you knew your current fiance for a long time, no matter if you apply for k1 or CR-1 you would probably need to explain this story to embassy anyway. I wish you all the luck.

You may need a waiver since you just filed. Front load your application/submission. I've read many african consulates are difficult so expect a lot of scrutiny.

a waiver is only needed if youve filed at least 3 times OR if your last one has been APPROVED in the last 2 years neither apply

Front load means loading up with a lot, and I mean a lot of evidence showing you guys are the real deal!

Front load mean providing a lot of evidence and providing it earlier vs later. USCIS actually requires very little evidence and they likely still wont care about any extraneous evidence but they will proxy it all to the NVC and such. Search the other threads, its highly encourage for high risk consulates and at risk cases.

It's better to wait some months. Then you will not have problem from the first Pettition.

Of course you have to say YES., about the question in I 129 F form.

I had the same situation , even more with a I 130 form before, and got approved this week with a fiancé visa. But u passed more than 2 y meeting and being in contact with my fiancé , you should have proves of ongoing comunication.

Expect a very intense interview....I would have been poised to ship this case back to USCIS at just under the speed of light, as I didn't buy the story of 'falling out love, then back in' within a few weeks....utter nonsense.
