Hello everyone! Quick question, We sent our packet to Lewisville TX, they cash the check and sent us an email saying the packet was transfered to the California USCIS Center, after that my fiance got NOA1 hard copy saying case is being processed. This means no RFS for our case? In which part of k1 process RFS are asked? Thanks!

No...They just made sure that you filled out the important bits, signed and paid. They do not "evaluate" your case at Lewiston. Any RFE's will probably start coming for cases based on your NAO1 in mid to late December...

then after they receive the rfe depending on how big it was it can take as little as 6 days up to 60 days.

 

so I would just review k1 guidelines here and try to figure out what can it be. If you can't come up with something, receive the letter and ask again here ;) 

Hi, I know this is a late , very late response, I agree with Naes, I believe that following the guidelines, not only for K1, but for future proceses, guidelines are easy to follow not rocket science in there.

Question about RFE

 

From the NOA1 date it has been nearly 5 months, with no change on the status website. If an RFE was going to come , would it have by now, or is it that they have not even looked at the application yet, and RFE can come near the end of the USCIS stage. Surely it does not take 6 months to do background checks and look through a file, I assume they just have not looked at it yet.

correct - they're taking about 6-7 months to process applications at the moment. Complete your timeline for an estimate of when they'll get to your case (based on data from other visajourney members)

what I was asking is,

If an RFE was going to come would it have by now. In other words, do they upon receipt, review a file to check for missing things or additional need for info, and issue an RFE if necessary, then set it aside in the line. Or do they make a very cursory scan of what is there, then when they get to it 6 months later, see something needed, and issue an RFE?

 Yes I see that the Calif service center is sending NOA2 in about 180 days.

No.

The NOA1 means the USCIS confirmation that they already received  your packet. After the NOA 1 you probably  can received a RFR if theres a missing or USCIS wants more evidence if you dont have a RFE the second thing that your petitioner will received is the NOA2

Hello all, 

 

So long story short, our lawyer forgot to send in my fiancée's (petitioner) proof of citizenship. We were gonna use the passport as the proof but she forgot to include in the packet. She sent in a supplemental packet about 2 weeks when we had our case number. This packet contained the proof of citizenship. But we called this week and a tier one officer said they have no records of a supplemental packet in our file, which obviously upset us tremendously.

 

So two questions:

 

First -  I've known that this would require an RFE, but is it ground for a NOID or just the RFE?

 

Second - Our lawyer also didn't write our names on the back of our passport pictures and printed out our pictures in black and white without on printer paper and without dates and where we were when the picture was taken. Will these two also likely be reasons for RFEs?

 

Thank in advance to any anyone who might be able to give me some insight.

Yes, you will get an RFE or NOID for the proof of citizenship, but as long as you provide all the evidence needed (and sign the form!!!) your case will move on. About the black/white pictures, I don't know if that will be a problem, but if you do get an RFE, provide whatever they are asking for.

 

It also might be worth calling and asking them.

 

I'd fire that lawyer too.

Really, you think they'll go to the extreme of sending me a NOID just because the lawyer forgot to send in my fiancée's proof of citizenship? Seem a little radical, no?

Yes its very possible.

They just passed new regulation where they are allowed to NOID you for something as 'simple' as that. They did so to fight off placeholder petitions where they send in just the petition and add the evidence later to win time. 

The rule should come into effect on petitions filed after August 1st but I've seen them apply it to older cases too.

That new guideline only comes into effect on September 11 according the USCIS website and only applies to cases filed after that.

 

Because I've seen on the RFE master list they they've sent out RFEs for no evidence that that petitioner is a US citizen, but those RFEs are a little old I wanted to know if something is different now, you know?

It seems that new rule is already taken into effect on some cases. That's why I commented. If you dont believe it that's fine. I hope you will be able to fix it soon. Good luck.

I'm not saying saying that I don't believe you, and I'm sorry if I came off wrong. I'm just saying that I thought it only applies to cases filled after September 11. 

 

If they're already applying it to cases, then I'm in some deep water 😔
