This is very simple all you really need it to say is along these lines:

I, (first and last name) am lawfully free to marry and will marry (first and last name of petitioner) within 90 days upon my entry into the United States.

It doesn't have to be super long or anything confusing. Just make sure that he signs it and gets it back to you asap. A wet signature is not required on this so if he can scan it and email it to you after he signs and dates it that will be sufficient.

So my rfe says

SUBMIT EVIDENCE FROM THE BENEFICARY,XXX 'XXX ,THAT HE PLANS TO MARRY WITHIN 90 DAYS OF HIS ADMISSION TO THE USA.EVIDENCE OF THE BENEFICIARY'S INTENT MAY BE Q STATEMMENT,WEDDING PREPARATIONS OR OTGER EVIDENCE TGAT CLEARLY ESTABLISH HIS INTEND TO MARRY.

I think a scan would be fine . I've read here many stating they've sent scanned letterso and they never got denied or Rfe for that. Ando also some screenshots of your chats where you talk about the marriage wedding plans where your fiance says he / she can't wait to be married to you and stuff...just to support the letter

So just a query cuz I am going to send reply to my rfe tommorow they send us a envelop attached to the letter that has USCIS Address on that.so i have to put everything in that envelop right? And attached the blue paper at the top of the evidence.everything is done just to make sure .i am not missing anything

That is correct! Definitely include the blue paper on top! That way they can easily attach it to your case.

The average is 2 weeks but there are outliers that are short or longer. They are required to make a decision within 90 days of receipt of your notice so if my some crazy chance you don't hear back by then, I would involve your congressman.

Do not worry though, most responses are within 2 weeks.

I was reviewing the Google Doc. of the RFEs. I see that some of the filers had an RFE about resubmitting the Beneficiary's birth certificate. I'm confused. I don't think you're required to submit the beneficiary's birth certificate at all. Why would you be asked to do so in an RFE? or was that an old requirement and not relevant anymore?

The Beneficiary's BC is not required in the original petition. There was no explanation as to why it was asked for in these cases either. The petitioner is still in the dark as to why they asked. The only scenarios that I could think of as to why they would ask for are the following (please remember these are just my guesses since we have no confirmed reason why they asked for it):

- Beneficiary was adopted and maybe they wanted a copy of it so they could have record of birth parents.

- Beneficiary name changed multiple times due to divorce or their own choice and they wanted to see their birth certificate in order to confirm their original name

- Beneficiary put a different parent name that is listed on record and therefore USCIS asked for the BC in order to verify the true name of their parents

Again these are just guesses and since the Beneficiary's BC is not required, they only ask for it when they deem it necessary. It is not old information, it has happened within the past year or so. It could happen again, but I wouldn't worry about it being a requirement for USCIS. The BC of the Beneficiary is usually reviewed at the Embassy since it is required to be brought with you to the interview.

I am feeling confused & frustrated. Received NOA1 08-03-16. Received an RFE on 09-14-2016 asking for proof of having met in the last 2 years. Included in our original pack were 3 flight tickets of my visits to the US, including Boarding Passes. 2 flight tickets for my fiancé visiting me in the U.K., including Boading passes. Hotel receipts. Internal Flight tickets to Edinburgh, including Boarding Passes showing adjacent seats. Over 30 photos of us at various landmarks in both the Us and UK.

Thankfully, I have just got back home from visiting my fiancé, so we have added a lot more fresh evidence. However, I can't think what else they could require!
