Timeline

I'm hoping someone can help me. I sent my final paperwork in to NVC form ds-230 and it was recieved by them on Feb 12, 2007. But my husband got an interview date on his K3. They are now asking for us to resubmit all the papers with translations again along with paying $100 for the nonimmigrant paperwork. Seems the K3 moved thru faster but up until he got this letter we were doing the CR1 paperwork. My question is can I or should I go thru with the K3 or should we just wait for the CR1 to be approved? Has anyone else been thru this?

I was going to apply K3 but for some reason the CR-1 is going rather quick. I personally going to leave it for CR-1. It just seem like it is moving along rather fine for me. At this rate, I'm sure I definitely get to be with her by 4th quarter this year. See my timeline.

As a note: This visa option is automatically applied for by K-3 applicants when they file the I-130 (part of the K-3 process). Historically the K-3 was used to allow the US Citizens spouse to enter the US faster than waiting for the I-130 to be approved (since that used to take a long time). Recent reductions in processing times have allowed I-130's to be approved quick enough that the IR1/CR1 visa process has been a quicker and better option for K-3 applicants. If this happens the K-3 applicant can abandon the K-3 route and persue the IR1/CR1 instead.

You can continue to pursue both, it's up to you. But my understanding is that once the consulate receives the CR1, it will automatically cancel the K3...and since you are so close to having your case complete at the NVC, it might be a waste of $100. It would make sense to look at the timelines to decide which interview is likely to come sooner.

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

Michael's K-3:

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

since your husband is from Morocco I strongly recommend the CR1 - scrap the k-3

this is because, the AP process in morocco is long. at some point the k-3 can become a dead issue on you. the embassy cancelled our k-3. we had been on AP for 10 months. what a waste of 10 months worth of time.
