Do I need a Permanant Residency Card?

I just contacted RapidVisa with some questions about direct filing in Manila. I was told that in some cases they require a permanent residency card. Do I need one of these and how hard is it to get?

I believe this is the info required:

To qualify for this visa, the applicant must prove that:

  • He contracted a valid marriage with a Philippine citizen.

  • The marriage is recognized as valid under existing Philippine laws.

  • There is no record of any derogatory information against him in any local or foreign law enforcement agency.

What does this mean? Is a police record from almost 20 years ago going to effect this?

  • He is not afflicted with any dangerous, contagious or loathsome disease.

  • He has sufficient financial capacity to support a family and will not become a public burden.

What is needed to prove this and how much earnings must I show?

  • He was allowed entry into the Philippines and was authorized by Immigration authorities to stay.

Can I get this Visa in Batangas city and how much is it?

Has anyone been delayed with a direct filing spousal visa for not having this?

You are asking about doing dcf from the Philippines and you are the USC and have been living in the Philippines? You have to be a resident there to dcf, not just visiting. Also you are aware of the requirements for a domicile in the US and sponsorship right?

No, I have been living in the Philippines for almost 7 months. I have a residence in the USA as well but I have been here in the Philippines. I believe the requirement to file directly is 6 months residence at least.

I am sure not getting an overwhelming amount of attention here. :(

At any rate I have heard that I only need to prove that I have been a resident here in the Philippines for at least 6 months but on the i-130 form instructions it does say a resident card is required.

Isn't there anyone here who has been through the procession the Philippines?

I do not know the specific requirements for the Philippines- hopefully someone who has gone through the process will post here. You can also search the posts in this sub-section and look for threads regarding that country.

In regards to residency-- you have to realize residence doesnt simply mean where you currently live or currently are. It means you have to demonstrate you are a legal resident of that location. That means you entered that country not as a tourist but as someone under a residence type visa. You have to show proof of you are legally allowed and have "resident" status in that country hence things like residency cards.

I cant go to XXX country and be admitted as a visitor and live there for 6 months and claim I am a resident simply because I have been physically living there for so many months. I am a tourist and that means I wouldnt qualify.

Belinda asked to try to confirm because again, not knowing the specifics of that country or your situation- it would appear if you entered not as a tourist but as an intending resident you would have such a card already and wouldnt be asking about it. Especially by your wording "evidence of stay here". Its not evidence that you are physically there and have been for 6 or more months that you need- its evidence you are a legal resident there.

Yes, thank you for the replies and the link. I have already done the research on this and ofcourse I have been to the link already. Manila, direct filing for spouse only needs proof of living here for 6 months. Not a permanent residence card.

I would just really like to hear from anyone that has been through the process of direct filling through Manila for a spouse.

No permanent residency card needed.

My wife was approved (DCF) and I just provided lots of different documentation that I have been here longer than 6 months (I had lived here 11 months).

Rent receipts, car insurance docs, drivers license etc etc.

I strongly advise having banking documentation signed by the bank rep and also strongly recommend a JOINT banking account here in the Philippines.

Seems like the whole thing took less then 2 months!

You didnt mention it in your post here but how long have you been married? If your wife enters the US and you have been married less then 2 years (on the entry date) you will get the conditional card and need to file for ROC in 2 years. If youve been married more then 2 years when entering you get the unrestricted GC (10 yr) The visa allows you up to 6 months to enter I believe so if you are close to your 2 year anniversary its worth considering waiting to use it.

I am so sorry but I should have been way more specif. I will also update the thread. Only our petition was approved thus far. We have not yet gone for the interview, etc.

We were married in June and our baby is due next June. :)

I did not need a permanent residency card for the petition. I did show my alien registration card and a few other things but we were approved without a permanent residency card.

Just wondering, what other documents did you submit for the DCF? and if it's not too much to ask can you share the entire process of your DCF.
