Philippine divorce and CENOMAR

Just for any who doubt still, yes, there is divorce in the Philippines. I will not pretend to know more about Philippine laws or courts than a native or anyone else with a lot of experience in the country. I only know what has transpired with my fiancee. She is divorced and the annotated MC states she is divorced and is permitted to use her maiden name. This same annotated MC was presented to and accepted by the embassy at her interview along with her divorce decree. She divorced a Philippine spouse in the Philippines so there are no foreign courts involved.

If I've read some of the replies correctly the NSO will issue a CEMAR annotated to indicate the divorce?

By the way, thank you all for your time and effort on your replies. This is my first time to post a topic and there are many more responses coming much faster than I expected.

she went to nso and let her decree of divorce annotated? and thats what it says in her cemar? am curious coz am the same situation like your fiancee... some people say i should get cemar and attach my divorce and submit that to the embassy. my interview will be so soon.. am a lil worry

If your CEMAR shows divorce then bring it along with your divorce papers and present during your interview.

no it doesnt show in my cemar that am divorce. still ex on it.. but i think am still good coz i have my divorce with me ? tho it isnt annotated one(the cemar)

Hi all,

Let me share my experience. My ex and I were divorced under the Sharia Law. We went through all the process and had our marriage contract annotated ; and on the side it states the decision of the judge and the date. "Termination of Marriage" etc.

So I was able to re marry with my husband last year. Regarding the CENOMAR/CEMAR ; PSA will give you what is applicable in your case. So in mine, I was able to get CEMAR marriage adivsory -- form 5.

It states the two marriages I had. PSA explained that for marriages that underwent Sharia Divorce there will be no annotation on the CEMAR; so it is normal to see both marriages. All we need is to attach the divorce paper and the court decision together with it.

In comparison to marriages that went annulment -- annotation will appear in the CEMAR like " with annotation of nullity of marriage"

jae&marianne - do you have your visa? Ours was refused. The Embassy cited several Muslim and Philippine laws to say that the divorce is not valid and so fiancee is not really divorced and does not qualify for the visa.

Oh wow thats terrible. As we speak tomorrow is our interview. I'm not sure about the difference since my husband I and were married through civil law in Philippine soil.

Prior to having approved BY USCIS last summer. i had an RFE of the jurisdiction and bi laws of the divorce that occurred in my place. Had my documents ribboned at the DFA here. After submitting those our petition was approved.

Anyway, hoping and praying for positive results tomorrow. :) God is in control.

My fiancee had her interview a year ago and the Embassy kept her case in a review status for months until her physical exam expired. I visited her in the Philippines and we went to the Embassy together and were told if she got a new physical the visa would be issued. That was in May this year. We went together for 2 days to St Lukes and got her physical done again and after it was sent to the Embassy the CEAC status changed to 'Approved'. When she didn't receive the visa after 2 weeks we checked on it and the Embassy said the approval was a mistake and the case is still being reviewed and had been referred to fraud investigation. Now 1 year after her interview they Embassy finally refused the case so we have to start over. The reason for the refusal is that she was first married in Philippine civil ceremony and not in Sharia court. Because of this they say she is not permitted a Sharia divorce even though the Sharia court granted the divorce. She also had documents from the DFA with red ribbon as well as a letter from the PSA to say the divorce cannot be annotated on CENOMAR but the divorce has been recognized by the PSA on her CEMAR as valid and true. So now we are beginning work to find a lawyer to file annulment.

Was your first marriage Sharia or Philippine civil ceremony? Were you or your ex-husband Muslim when you were married the first time?

Ok this may help you. Divorce is not only not allowed it’s illegal in the Philippines. Now this is only for Philippine citizens and does not apply to anyone else. So the question is this. Is your girlfriend a Philippine citizen? If she is and she was divorced in another country she is still married as far as the Philippine government is concerned. So if she got a divorce let’s say in America then it’s not recognizing in Philippines. She will need to get an annulment before she can get married again plain and simple. One more thing I want to ad is that I have heard this story before and sometimes it is true but sometimes it is a lie that’s just covering up the truth so she can continue enjoying what you give her. One thing that would worry me the most about this story is that she says she recorded the divorce with the NSO. They not only don’t care about divorces in other countries they don’t bother recording them because they mean nothing as far as the Philippine citizen is concerned. If it was me I would be finding another woman that could produce a cenomar.

I don't know what to tell you, Jimmyasshole,  my original post you have replied to is now obsolete but a lot has happened since then.  Not only was her fiancee visa approved but it was also issued as a large stamp in her passport.  Two weeks after issue a supervisor in the Embassy revoked it so there could be something to what you say.  On the other hand, we submitted an application for a marriage license and it was approved by the PSA.  We were married in the Philippines and now have our first child.  We have submitted an application for a spouse visa and it is currently processing thru the USCIS.  Her CEMAR is annotated with the divorce and also shows our marriage.  How this will play out in the Embassy is anybody's guess right now but I expect a successful outcome.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
