Hello everyone. My fiancée (now wife) came to the USA on the K1 visa back in August. We got married last week and now I am getting ready to send all the AOS forms in to try and get it done before the 90 days are expired. This site helped me tremendously throughout the K1 visa process but now I finally registered to ask a question. I have two questions.

  1. All the K1 visa documents for her were filled in with my old address. I bought a house since then so now we live in a new address. Should I fill out all the documents for AOS with the new or old address. The old address is where my parents live so I would still get all the mail. I also heard I shouldn't do the chage of address for myself from the old to the new because they will get confused at USCIS. Is this true?
  2. Can I just send the temporary marriage certificate they gave me at the marriage court or do I need to wait until I get the new one? They told me I have to wait 10 days and then go to get my marriage certificate, but I don’t want to pass 90 days since she entered the USA.

Congrats!

1. I'd put a new addres, since after that they may ask why'd you put on your parents addres.

2. Just send a temporary with a notice of explanation about your marriages certificate. Don't wait. Even if you get RFE from them asking for copy of original it's better than have complications applying after 90 days!

The requirement is only that you get married within 90 days. You can take all the time you need to file AOS (though that might mean waiting to be able to get a driver's license or work or travel out of the US). I would wait until you have the marriage certificate. No point in rushing to file AOS only to get an RFE later.

Sorry I can't help with the address change. I don't know anything about that.

Hi!

Congratulations!

1) Put your new address, there is no issue with it being different from the K1 address (people move, even USCIS understand that). It will also be easier for you to receive relevant mail and to prove that the two of you live together at this address (which you actually do).

2) Personally, I would wait a few more days for the correct document. Unless you need to get AP to travel as soon as possible, there is no rush to file for AOS. As long as you got married within the 90 days, you are fine. You're facing a longer delay if you receive RFE anyways.

If it isn't difficult, it isn't worth it.

Use the new address. that's what we did and they didn't ask any question when I did my biometrics.

As for the marriage certificate, you can just go to your court and get a certified copy. That's what we did.

Thank you for the quick replies! I’ve never gotten an RFE and generally our whole process has been very smooth and satisfying. We sent our initial application for the K1 at the end of April and she arrived in the USA at the beginning of August. So I just try to get everything done on time and correctly. Anyway, we hope she can receive an AP for a possible trip outside the USA at end of January. Is this feasible? Is the real marriage certificate needed for the AP? Currently, the marriage certificate should be available on November 6. But I wanted to send everything in by Monday to get a bit extra time and hope for the AP to be approved by end of January… henceforth my dilemma.

1. Put your current address on all AOS forms.

2. You need to wait until you have the official marriage certificate that has been recorded in your county/state. If you send the one you have now, you will most likely receive an RFE for the marriage certificate. This will delay processing of ALL your AOS forms, including EAD and AP.

There is no time limit to file AOS. It is perfectly fine to file after the I-94 is expired.

Can't you get a certified copy at your court house? It usually is pretty quick... within a couple of days your marriage is registered in the system. That's what happened to us. We got a certified copy right away from the court and we didn't get any RFE.

I suggest that you file it ASAP because the process itself (AP, EAD, etc.) takes a lot of time. I'm already over 2 months in and no EAD or interview.
