Hello,

My spouse and I just bought a house together. I was wondering if buying a house alone is primae facie (legal word for obvious & convincing) evidence of a legitimate marriage for ROC purposes.

In our I-751 petition we will highlight the fact we just bought a home and use the Deed of Trust, the Final Closing Statement, home insurance, and the initial joint mortgage application as part of the evidence for our form when it is due to be filed the end of this year. However, just to be sure we are also submitting all the other evidence we have which are numerous:

  • Joint tax returns from 2013 and 2014
  • Previous joint apartment lease
  • Joint checking account
  • Other joint insurance policies (life, auto, health, dental, rental, and umbrella policies)
  • Joint utility bills (PGE & Comcast)
  • Driver's licenses showing same address
  • Joint Costco and AAA memberships
  • Photos of second wedding celebration for the French family in France (6 months after receipt of green card)
  • Affidavits from friends & family

Now with the house, I feel we have so much convincing evidence that we don't need a lawyer this time around and we should just file the I-751 form ourselves and save the lawyer's fees. Other than missing the deadline (not gonna happen!), what could possibly go wrong?

Owning property with your spouse is probably rated higher than having a baby together for reasons I won't bother getting into. But in short yes, it's very good evidence of a relationship/marriage.

From my experience with your evidence you'll get approved within approx. 8 months with no RFE.

I'm not sure why you used a lawyer previously (imo a waste of money), however you definitely will not need one for your above application.

Looks like you have a good list. Be sure to copy ALL pages of your bank account statements. I've seen several RFEs lately because the couple only submitted the FIRST page (which you think would be just fine, but it seems not).

Especially because you have a little one (if your picture is correct), please consider wills and medical power of attorney forms for each of you. These rate up there just about as strong as two names on the house - and, in many ways, are far more important in life.

However, just to be sure we are also submitting all the other evidence we have which are numerous:

Looks a pretty good list of marriage bonafides, the more, the better. How about wills? Hopefully you will get an USCIS adjudicator that agrees with your assessment.
