Hi everyone,

I've been in the USA for 2 months now, I applied for my SSN in the 2nd week of being here and just two days ago I received a denial letter. The letter was not very informative, so I returned to the local SSA office to ask why, and what I should do. They literally just had me apply again, same documents, same information, same process. I made them aware that I'm here on K1 visa of course, and that I only have a valid I-94 for 90 days from entry.

I don't know what I should do now. I have filed for AOS and EAD in one go and I'm waiting still to hear back from them, but I don't know if I've done everything I need to. I can be sure that for my SSN, AOS and EAD that I have completed them fully, and don't think there should be any issues; our situation is very 'normal' and me and my wife have been married for a little over a month now.

As for the SSN, the only explanation I got was that if an application and it's documents is not verified electronically then it gets sent to DoHS and has to be manually verified - this is what happened with my first application, though it was never verified even then - and apparently if an application is not verified within a certain time limit then it is automatically denied.

This is very frustrating, but I feel like there's very little I can do. If anyone can advise me or at lease give me peace of mind, I would be very grateful :

Is there any more I can do with regards to getting my SSN in time?

Should I be worried about my I-94 expiring if my AOS and EAD applications have been sent off?

Is there something I need to do to 'renew' my I-94 or permission to stay if I haven't heard back from any of my applications?

What should I expect to receive with regards to my AOS and EAD? Any letters or documents stating my status?

Is there anything else I should be doing?

Maybe they couldn't verify your information electronically since it wasn't put into the system yet? Given the fact that it was only your 2nd week here. Hopefully, you'll get the card in the mail now.

When did you send your AOS petition? You should receive a receipt notice and as long as you have the petition pending, you're authorized to stay in the US. The receipt notice is proof that the petition is still waiting on adjudication.

The I-94 can't be renewed and it's not necessary in your case.

All you need to do now is wait and wait. Best of luck!

No....but what do you mean "in time"? You won't really need that until you begin to work and you need the EAD for that.

It's only valid for 90 days. Can't renew. You will technically be out of status but a keep copy of your 485 application as well as a copy of your NOA2 and marriage certificate handy.

You are out of status. You should receive a 797 Notice form stating that they received the application documents and then about a month later a letter for you to do to the nearest USCIS office for biometrics (fingerprints and photos). The EAD/AP take about 3 months to get and the GC 5 or more, depending if they want to do an interview or not (usually not, but not a bad thing if they say yes).

You need at least 14 days of validity remaining on your I-94 of you're applying for an SSN simply by virtue of your K-1 status.

Failing that, you will need your EAD to be able to receive a SSN.
