HI EVERYONE, PLEASE I NEED YOUR ADVICE ONCE AGAIN, MY FIRST COUSIN IS AN AMERICAN CITIZEN, HE HAS ALREADY PUT IN A FILLING PETITION FOR HIS PARENTS WHICH IS STILL PENDING TILL SOMETIME NEXT YEAR, NOW HIS WIFE IS DUE TO GIVE BIRTH TO THEIR FIRST CHILD BY NEXT MONTH AND HE IS THINKING OF INVITING HIS MOTHER AND HIS 18 YEAR OLD YOUNGER SISTER OVER SO AS TO ASSIST WITH THE BABY, NOW MY QUESTIONS ARE

1, CAN HIS MOTHER AND YOUNGER SISTER APPLY FOR A B1/B2 VISA FOR THIS PURPOSE WHILE THE MOTHER HAS A PETITION THAT IS PENDING?

2, WHAT IS THE CHANCE OF THEM GETTING THE VISA ESPECIALLY HIS MOTHER?

1) Yes, they can apply for a B1/B2 visa even though they have a petition pending. They will need to prove strong ties to their country indicating they will return instead of staying in the US.

2) Chances depend on how strong her ties are to home. Does she have a job, school, other family she'll leave behind, business, property that she'll need to return to?

1. No. One cannot use a B2 visa to babysit a child. That is taking work away from an American Citizen and would result in a denial.

2. In my opinion? 0% if you do not apply, 1% if you do.

A high possibility for the mother to be able to secure a B1/B2 visa because she has a pending petition. She has a solid reason to return to her home country due to her petition is still pending. As for a sister I have no idea. The sister has to proved to the consulate officer that she will return to her home country. She must have a solid proof that she'll be able to afford the trip to the US and an evidence that will convince the consulate officer that she will not stay in the US illegally

All I can say is they can always try applying for B1/B2 visa.. Sometimes it's just a matter of luck.. There's no harm in trying..
