30 days is the required time for USCIS to tell customers, standard response on the phone. You can check on VJ for timelines, and I'm pretty sure you will not find one past 10 days. They are very efficient in Dallas.

You are sort of stuck between the proverbial rock and a hard place. Almost need to go through the lost and found procedures with the USCIS if the lawyer's office will not confess that they did not send it in. If they did send it in, suppose it was yesterday and will not tell you, then you will need the protection of the lost and found report if you submit again---duplicate. It would be the best world if the lawyer did not send it in at this point.

You have a choice. Either beat them over the head with a baseball bat (figuratively), or be nice to get them to tell you the truth. Vinegar or honey with the bee theory--I swat the bees, but that is another story.

What you absolutely need is the truth. Did they really send it in, and if they did when. Keep in mind, they rarely admit fault.

Sorry, but this is a hard hard path forward. It will slow your schedule down considerably. So whatever you do, you got to do it soon. Otherwise everyday is going to push your timeline that much further out.

What does everyone else think?

Well I know for a fact that when money is sent into the USCIS they are REQUIRED to deposit the check/payment within 2 days of receipt. If your check is not cashed then it was not sent or it was sent to the complete wrong address.

The fact that they can't provide tracking tells me they lost it, they haven't sent it, they JUST sent it in and don't want to tell you OR the cheap A$$ lawyer's office just threw some stamps on your envelope and dropped it in the mail box.

Hey Jamie I think it was you who posted a link to the inter-workings of the CSC and it had an email to the Dallas Lock-box. I wonder if he could attempt to email them although it seemed like an internal memo or for lawyers.

Note the peaking at 40%, I have a feeling the Nov 12 curve will do the same. I guess my next project will be to look at older data to see if we have the same 40% plateau and how long it tends to stay there until it starts moving again.

During the weekend I had this vision of the processors enjoying their Christmas... erruhhh... I mean "Holiday" celebration at work. Them eating their sloppy food while using our petitions as place-mats.

I decided to call a friend of mine who works in a federal job. He does not work at USCIS but was very involved in INS years ago. So he has a few contacts.

Long story short... (this is third-hand information) he did some inquiring. Some of this confirms what we already know or suspected (if accurate). The majority of the agents are cross-trained. Meaning they have the ability to process whatever type of case that comes across their desk. They are assigned cases and that case stays with them for the duration or in our case, when forwarded to NVC.

This part might explain your delay. Certain cases (primarily K-1 applications) now considered "higher-risk" have recently been assigned two sets of eyes, meaning they are checked and approved, then parts of the petition are handed to a second person for reevaluation and then returned to the original processor. The second look currently is adding roughly 7 to 10 days to the final approval before being routed to NVC. I suspect this is probably the result of the recent incident in California (among other things).

Perhaps some good news for you/us: The word is that Tuesday the 15th through Wednesday the 23rd is 95% staffed. Apparently they are under pressure to clear out as many cases as possible before the 23rd. The majority of new cases coming in will not be processed until January placing emphasis on current workload. He couldn't find out anything about my petition, I am guessing they have strict rules on that. The encouraging words I was told was that if we have a NOA1 date of 11/25 or before, most likely we will see approvals this week even if our case had a second look. I think that is evident based on the recent approvals.

This was the Reader's Digest version. Apparently, now it does matter where the fiance is from.

Whoa our NOA1 is dated 11/24. We really hope we are in the approved group before Christmas. This is so reassuring. And it seems to be happening, as we see so many NOA2s a day now =D so exciting!!!

There were 5 RFE from Nov 2 filers issued on the 15 of Dec. Not to many approvals that day.

Last night i couldn't sleep, so i sent email to someone suppose to run the office (lawyer i guess) and will also call them first thing in the morning when they open and get to the bottom of this. Last time that I talk to the person that suppose to handle and check on my case. I told her that by this time USCIS should have deposit my check and forward my petition to either California or Texas for reviewed, she was surprise to see that i know how the process work (base on reading on this forum) and she kept insist that there ONLY one service center in Texas that handling Fiance application.

I have a NOA 1 date of 11/10 and still have zero movement with my case. No alien registration number created, no noa2 Nothing..........is this normal?

Also if you wake up in the day and check uscis website and see no update does that mean there will be zero update all day? meaning does it only change in the mornings or does it change at anytime throughout the day to keep looking back?

Also if you wake up in the day and check uscis website and see no update does that mean there will be zero update all day? meaning does it only change in the mornings or does it change at anytime throughout the day to keep looking back?

Base on my experience their website changes around 11pm.

But if you sign up for notification you will get an email when your file has been updated

I check every 30 minutes--sometimes more often, sometimes less but mostly 30 minutes-- during my waking hours (minus toilet, sleep time). I use the USCIS phone app to simultaneously check 40 petitions that are numbered close to mine.

At home, I check the 150 petitions (I have a spreadsheet) that were sent in for my receipt date of November 2. I have to do that one at a time. I also await our resident guru's automated update with colored graph for % completion.

In between I do some work to remain employed, but luckily this is the Christmas holiday season and the expectation to do real work is pretty low---perhaps same as it is at the USCIS and thus we have a slow down :clock:

I check Igor s list every morning to see if I was approved. That list is very on point and up to date every morning.

I check every 30 minutes--sometimes more often, sometimes less but mostly 30 minutes-- during my waking hours (minus toilet, sleep time). I use the USCIS phone app to simultaneously check 40 petitions that are numbered close to mine.

At home, I check the 150 petitions (I have a spreadsheet) that were sent in for my receipt date of November 2. I have to do that one at a time. I also await our resident guru's automated update with colored graph for % completion.

Igor's list is updated by us, the VJ members. It does not tap the USCIS site; recall we do not enter our receipt number anywhere so there is no way for Igor to access that information for us. Perhaps not a good place to check on the status of your petition.

(2) The percent of approved petitions will likely not equal 100% due to members that have not updated their timeline or if there are very long delays for their case.
