HI all,

Im still waiting for the lawyer office to get back with me with the tracking number (sadly if i was close i would sit in there office until i get it, but im 2200 miles away :()

In case they lie to me and it never filed or lost, what would be the next step? Contact USCIS so they can investiage if my filling was received ? Or send re file it ? What would be the best way I don't not want to rush and end up having double file which make thing worst.

You can't send in duplicate petitions without concurrence from USCIS.

So best to call tomorrow morning, and explain that you sent the petition in several weeks ago. Do not talk about the lawyer, and not knowing what they did. Ask them if you could submit again, and you will send it Fed-Ex with tracking this time. Always good to take responsibility, and apologize multiple times.

make sure and call the lawyer. Be real nice and ask for the petition file, all of it. Let them send it to you by email. you only need original signatures on I-129 and your bio 325.

That is my suggestion.

I layout the time line base on the infomation she gave me and she still deny that my application is not lost and it still processing at USCIS which is 100% BS (base one the date of filling and receiving of notice of most members here)

The lawyer office told me wait 3 - 6 weeks while USCIS said up to 30 days, which make me worry more about this lawyer office. Yesterday i kept pressing her for the tracking number but she keep saying she is on a differen tsystem and doesn't have it (what kind lawyer office work like that, doesn't know what exact my application was send, didn't know the darn tracking number)

Tomorow i will call and talk here superior or who is in charge at that office and get to the bottom of this,

30 days is the required time for USCIS to tell customers, standard response on the phone. You can check on VJ for timelines, and I'm pretty sure you will not find one past 10 days. They are very efficient in Dallas.

You are sort of stuck between the proverbial rock and a hard place. Almost need to go through the lost and found procedures with the USCIS if the lawyer's office will not confess that they did not send it in. If they did send it in, suppose it was yesterday and will not tell you, then you will need the protection of the lost and found report if you submit again---duplicate. It would be the best world if the lawyer did not send it in at this point.

You have a choice. Either beat them over the head with a baseball bat (figuratively), or be nice to get them to tell you the truth. Vinegar or honey with the bee theory--I swat the bees, but that is another story.

What you absolutely need is the truth. Did they really send it in, and if they did when. Keep in mind, they rarely admit fault.

Sorry, but this is a hard hard path forward. It will slow your schedule down considerably. So whatever you do, you got to do it soon. Otherwise everyday is going to push your timeline that much further out.

I've herd many good reviewed about them, they also have satellite office in her country to support and assist with the papper work which is why i chose them.

I think what i do tomrow is call USCIS so they can start the lost an found process, this way they can start investigate and have an answer where or not my filling was received? If it never received then i have concrete evidence to tell them they do not have to wait to till 6 week to look in to my case ?

also at the same time, call the lawyer office and try to get the truth and the tracking number.

what do you guys think ?

Despite how great this law firm is supposed to be, I am not getting that vibe. They absolutely have a hard copy file with all of your information. That was stated before. Them telling you it is on a different system is just a game they are playing with you. I have dealt with many legal firms in my life and this is almost the most ridiculous thing I have heard. I probably would not be so nice at this point if I were in your shoes. My opinion is that your issue is with this lawyers office. I am a big "chain of command" type of person. The lawyer is the last and only link you really have, aside from anything you do on your own from here forward. The lawyer has your paperwork (or copies), the lawyer has your money, and if they really sent it... the lawyer has tracking information.

I don't know what they told you or what services they said that they would provide. I have no clue what questions you asked them... and you should have asked plenty. If it were me, I would explain to them that you paid them money for their services and you want proof that they sent the paperwork to USCIS. That is part of their service. If they can't provide you with that, then tell them that you are losing trust and confidence in them. You can ask for a refund. Whatever you decide... remember this: They Work For YOU. You pay them therefore they answer to you.

This is why I would never hire an attorney that is more than an hour drive from me despite how good of a reputation they have or the conveniences they offer. In fact, my attorney told me that I would be better off doing the paperwork myself. He saved me a lot of money and aggravation. I hope things work out for you.

I agree with what Jaime said... you need the truth.
