This is a Sir Greenbaum question.

I know that the tax returns are not required for the I-134, or any proof of support. The I-134 is very specific on what is required.

My impression was that the tax returns are part of the later AOS. But the consulate, as part of due diligence checks to make sure the petitioner has filed. This is more to prove the petitioner is up to date with paying federal taxes, and compliance.

???

At the interview you should be able to demonstrate that you will not become a public charge or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form will be

useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You will be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

If your Embassy requires three years, then submit three years. If only one year then only one year needs to be submitted.

For the AOS after marriage you will complete or include I-864, employer letter, 2013, 2012 and 2011 tax returns, W-2 forms and one month of pay stubs. There are other requirements which you will learn at the time of filing the AOS.

That goes with you to the interview along with the required I-864 we suggest that you complete the I-134 (and supporting documents; tax return-current year 2014, W-2 and one month of pay stubs) for Evidence of Support.

Thank you Greenbaum. I just thought we need to file it to USCIS and my fiance needs to send me an approved one.. So he just need to sign I-134&I-864 and send them to me? plus the supporting documents.

I hope everyone understands what is needed for the interview with regards to financial documents. If your documents prove that you surpass the 125% poverty level then you have no need to worry. Your going to be fine. If you below there are some options to consider.

Keep in mind that you must check with your Embassy to determine what they require. Some are still requesting 3 years other 1 year and even others NONE.

As long as he can show that he is above the poverty line for his household size, then it will be enough. Everyone is over thinking this process. Just submit what is required by your Embassy no more or less.

Haha thank you so much, I love your responses so direct but on point ??

I am not known to sugar coat my answers. I hope in doing so I do not offend anyone.

I try and put myself in those who are processing now and think back to how uncertain I was, but with other's help I too was able to make it through to approval. With their help I processed through very fast and only had one hiccup (221(g)). I knew what the possible delay was and I tried fixing it 2 months before the interview but the Philippine Government does not do what they say they will do nor do they complete what the say there going to complete in a reasonable time. I sometimes was frustrated with dealing with a 3rd world country. As an American I am spoiled that I can walk in a door and walk out with something being updated and or rectified. What Jaime is going through with internet and phone interruptions I would never make it. I tip my hat to those who are facing that obstacle and are dealing with it. Your much better then me.

What bugs me the most is when I send somebody to the answer and they don't go and read the information but will ask the same question later in the thread or I read it in another thread where they posted the same question and others have answered the same way I did. Sorry, after that I do not respond to your questions or lend you help. It's just a pet-peeve of mine.

When I am wrong I will admit that I may a mistake. But I avoid that possibility and direct people to their Embassy for further directions.

Speaking of what bugs me is when someone ask the question "what do I do next". Grrrrr The answer is did you read your Embassy's website for instructions.

So don't take anything I say personally. Just know that I am trying to save you heartaches and delays during your journey. Thanks everyone for your understanding. I really enjoy this group and if I don't say it enough just know that I am on everyone side and cheering you along.

Greenbaum- definitely we understand! We appreciate your answers and knowledge a lot. I feel like sometimes other people make you question what you think you already know which causes you to overthink. And as far as the "what's next?" I always check the guide that's posted on the VJ website and my embassy packet, it's all there, so I get the frustration that comes from people asking that over and over ?

I just cannot wait until the interview is over, then I'll be the one giving advice and telling people to relax and not overthink ?

Sir Greenbaum, perhaps this is Filipino thing regarding completion of the I-864 as part of the K-1 submission?

http://www.visajourney.com/forums/topic/476927-i-134-vs-i-864-affidavit-of-support/

Please advise

Try the paper bag......

The submission for the initial application is non-country specific. Everyone submits the same paperwork. Having said that here are three resources that state the requirements with the submission of the I-129f and the I-864 and/or I-134 for that matter are not required.

Same thing for the co-sponsor. If you have the most current document that's requested and it shows you are over the poverty line neither you or your co-sponsor needs to submit anymore tax documents. They are not that concern about your finances, just that you meet or surpass the poverty line. Don't over think this process it's not necessary.

Being above and being the amount above they want are two different things. I am above the poverty line but not above enough to not require a Cosponsor.

Sir Greenbaum now I am pulling out my paperbag again. I had not read this instruction about proving you are a US citizen if born outside the USA.

I was never issued a FS-240 form.

I provided all my birth documents I had as part of the I-134 which I front loaded. Now I read what you sent, and I see this instruction about the FS-240.

I was born in a US Army hospital (my mom was a US Army Captain, and my dad a US Army Sgt) outside of Paris (that should tell you I'm old). The consulate issued the birth certificate (FS-545), the French issued 2 other documents that I can't read (in French).

In 1999 I got a job that required me to show my social security card, which I had lost. I went to the SS office and they laughed, because I was in their system as a 'non-citizen'. They said it was not a big issue, just show them my birth certificate which I had with me (always prepared). They corrected it. But now I am wondering. Since I don't have a FS-240 will that be a issue?

Before my fiancé and I decided to move to the US, I moved to his country (Peru) and applied for residency there. The process there is very fast compared to the US (took me about two months from start to finish) and much cheaper, but it was so frustrating because of the general lack of organization and information. No info online for some steps, or only out-of-date info. No phone number to call and find out what I needed to provide for certain steps. Immigration would ask me for a paper from the work ministry, the work ministry would say they no longer provided those, I'd go to immigration and they would insist they needed it. When I went to the office one person would tell me one thing, and the next day a colleague would contradict that. I'd ask for a list of documents to bring, would bring the full list they had given me, only to be told I needed another document and "oh, you don't have it? Then we can't do anything." I had to travel twice to the capital, a 20 hour bus ride (or short flight, but expensive given that I couldn't work), etc etc ...

This process is long and stressful and requires plenty of documention, but personally I at least feel that it's clear what we need to do. You can find most of the required information on official websites, and if not, there is almost always someone to call or email who will eventually answer. I feel that the process is much more fair and standardized - not perfect, of course.

I'll definitely be glad when I no longer have to interact with immigration offices!

I was also born outside of the US - actually, also in Paris!

But I thought that for the K-1 visa process, submitting a copy of your entire US passport (if valid for more than 5 years) was enough - and negated a need for birth certificate + CRBA. Interested to the answer to this too.
