Greetings!

I hope I will get any advice in here.

I was denied a K1-visa last year January 2014 in reason of no bonafide relationship with my fiance. So just this year 2015, we got married by July and then after that,we hired a lawyer to help us to do the process so last September ,our immigration lawyer already sent a spouse visa petition using my maiden name and already got our receipt number and has been waiting for the next step. I asked our lawyer if I can change my passport in my married name but she insisted me not to change my passport because it could conflict the petition but I read some forums here that changing status in the passport in my country is better than changing there in US. Is it true that if I changed my passport, it could conflict the visa petition? Please need some advice. Thank you

Changing her passport to her married name won't affect her visa process. However, she will need a CFO certificate in order to complete the name-change process. That means that she will need to attend the CFO seminar. Then, when she gets her visa, she will not have to attend the CFO seminar again. She only will need to get the CFO sticker attached to her passport.

By the way, did you withdraw your K-1 petition with the USCIS after it was sent back to the USCIS? Or, did the USCIS notify you that they revoked your K-1 petition?

I have already read this and its kinda different with my situation. But thanks anyway.

Ok since you have already read that thread it seems like you never understood the replies... np

The answer is NO .. it should not affect your Visa application.

If you want to get the name changed Better do it now while your case is still at USCIS before the NVC stage when you will be asked to provide your passport details.

All the best! :star:
