I don't know if we'll get someone to co sponsor for my spouse. I'm living with him here in Morocco and have been for 5 years. They don't do DCF in Casablanca anymore which sucks.

I haven't filed taxes in the time I've been here because technically I haven't made enough to need to. This is because my declared income is low. On my pay stubs is actually only about half of what I actually make because my company only declares that much, I think they're tax evading liars. Another story. But you see this is affecting my ability to prove that I make enough to be the sole sponsor for my husband.

So when I go to America, they will pay me more because price of living is higher, and all will be declared and on my pay stubs, but I'll be considered self employed and have to pay taxes accordingly, so they've nothing to do with my taxes at this point. They win, everyone's happy.

Question!!!! Should I go home after we file the I 130, work there with my higher wages, accumulate proof of that so that I might be the sole sponsor of my husband? Would I have to wait to have a tax return to prove that? Even if I did, it will only show that higher income for a short amount of time and they might not even consider that enough to take on the responsibility to sponsor him.

Hard one.

If you file the I-864 being self employed, you need at least one year's taxes, because they go by lone 22 of the tax return for self-employed people, so that would be quite a wait.

Can you cast your net wider trying to find a co-sponsor?

I'm trying. My mom is afraid to do it because of the legal obligations.

But wouldn't the sponsoring responsibilities and legal ties end once my husband becomes a legal permanent resident? On average how long does that take?

The obligations of the I864 end after the immigrant becomes a USC or has 10 years working in the US, so for a minimum of 3 years

You may want to have your mom read the I-864, her responsibilities would be relatively limited (only if the immigrant ends up on state assistance), and you would still be the primary sponsor, so they would go after you first. Thus if you have a good chance of a well paying, stable job in the USA, her risks are minimal.
