Did you FedEx your new G-325A, letter of intent to marry, and passport photos to your fiancé yet, so he can file a new petition next week?

Nope not yet .. can we start it as soon as possible ???

We dont need to wait until USCIS received our petition from the Embassy ????

I think you should get rolling on your withdrawals / new petition tomorrow. There is no reason to wait.

Hi I just want to share our experience.. before our petition went to the NVC, the USCIS made a background check and they found out that my husband sponsored a fiancé visa in 2010 so they emailed him and ask for a letter (just a simple letter) stating that he already stopped the petition with a the name of his ex. You are not denied just give them such letter for formality that your fiancé stopped the sponsorship in 2007.

You are not denied just give them such letter for formality that your fiancé stopped the sponsorship in 2007.

Hi thank u for sharing :) Ours was transfered to nvc then to embassy .. on the day of our interview the CO tells me that they cant issue a visa bcoa of this issue .. and it will be return to uscis for reconsideration and disposition ..

I wish the USCIS had noticed the issue when they were adjudicating the petition, but they did not. Now, the petition will be returned to the USCIS. At that point, we really don't know what the USCIS will do.

The USCIS may sit on the petition and allow it to expire. Then you would have to start over. You would need to send a new I-129F packet including the withdrawals and a waiver letter.

On the other hand, they may issue the petitioner a NOIR. If they issue a NOIR, I don't know how long it will take for them to process everything. It could take a long time, with no assurance of a successful outcome.

Will the USCIS simply email the petitioner and request a withdrawal? I doubt it. Even if they did, that process may take a long time.

I still think the quickest path is to start over right now.

Did your fiance stated on a form that he sponsored someone before? I remember my husband filling that form and telling me that he should state that coz they will find out later, until he received that email. In your case, I think you should tell your hubby to respond to USCIS to clear everything out and after you receive a reply from them then you can go back to the consulate and proceed.

if we file again and he withdraw the 2 petition do u think they wont questioned it anymore ??? 1 of his petition that he withdraw is my name too .. if we file and they see he withdraw it and we just file again it wont be a cobflict anymore ???

That should not be a problem. Your fiancé can explain the circumstances in the withdrawal letter. He should be able to use one withdrawal letter for both withdrawals.

Ok thank u ! Ill make one tom.and try to post it hir and i want to know if that letter will be fine .. we need others opnion so we wont make any mistake again. Im so happy so many people trying to help us ! Were so blessed guys ! Thank u so much !!!
