Hi there, I was wondering if anyone knows how long your case will remain open once it is approved?

I have recently found out I can reunite with my spouse who is in the UK (EU citizen) and have a decision on my visa to travel there within 15 working days...so much faster than waiting for him to get here...feeling quite desperate as I am sure you all understand! So this was wonderful news I just received. However, we would still like to live here in the US in the long run and would return in a year or two..

Hi me again. researching this topic more since it is an issue to me as well and here is a paragraph from my email notification that contained our case number and invoice number. There is a paragraph called 'Termination of Registration' that says ". . . the Secretary of State shall terminate the registration (petition) of any alien who fails to apply for an immigrant visa within one year of notice of visa availability. The petition may be reinstated if, within two years of notice of visa availability, the alien establishes that the failure to apply was for reasons beyond the alien's control. Therefore if you do not respond to notices from the National Visa Center within one year you risk termination of your petition under this section of law and would lose the benefits of that petition, such as your priority date."

hi there! thanks for looking into this...I have read that if you stay in contact with the NVC every year then they will keep the case open but I have no idea how accurate this is or if its consistent across visa centers. I'm not sure what to do! He has work over there already and it is certainly more convenient if we could go there but I don't know how much this qualifies as out of our control..:/

After that two letters from potomac. Saying that I have to wait from the date of the letters 60 day for a decision on the case. Today April 12th case for my father was approved. Good luck everyone. So happy. My mother application is waiting at NVC now can be completed. Together yeahhhh

there is only one NVC, it's the National Visa Center, and this info is kind straight from the horses mouth as they say. It's the Immigration and Nationality Act (INA) section 203(g). Good luck with whatever you can figure out!!

Hi All,

I just wanted to give an update on my case pending for my wife, because our case got approved yesterday from the Potomac Service Center.

I-130: Filing for my German Spouse.

Sent: January 18, 2016

NOA1: January 22, 2016

NOA2 (Approved): April 12, 2016

Total Time to Approval: 81 Days

Now we wait for the NVC to receive our documents. Does anyone have experience with how long it will take between NOA2 and contact from the NVC?

Also on a side note. My wife is from Germany and she recently visited me for 2 weeks in the U.S. She arrived on March 25, 2016. She came in during her green card pending. She had ABSOLUTELY NO PROBLEM in the airport. The board control folks didn't even ask her a single question about being my wife or anything like that. It was the same procedure as every other time she visited the U.S. We read so many stories about awful things that happened. But she was only staying here for 1 week actually, then we flew to Jamaica together. While she was her she was able to get approved for Global Entry so now we will never have to deal with boarder control and we can just go to the electronic kiosk and not deal with any people when entering the U.S. The whole process was incredibly easy and no problems what so ever.

I also have some information about getting an ITIN for spouse and how to file taxes in this way for a non-resident alien. Everything was super easy, and I did it all filing myself. So if anyone has questions, please PM me.

Hopefully this information is helpful. Good luck to everyone! Wish us luck too for the rest of our steps :)

That's great news. My PD: 12th Jan hope we get some good news soon.

Even I was thinking if my spouse could come on visiting. In my case he will have to apply for Visiting visa. I don't know if this will cause any issues.

I should have made that clarification elhourney. My wife traveled here on the ESTA (Visa Waiver program). So I am not sure if a regular travel visa would get approved during pending greencard. But honestly, I don't think it would hurt to try. However, I am not a lawyer so I am only making a guess at that. But we applied for Global Entry after our case was pending and that involved going through research of her past and documents from the German Federal Police and whatnot, and we had no problems. So anyway, don't know if that is helpful, but just wanted to clarify.

That's great news! Congrats! My Spanish husband did the same thing actually! Our PD is February 5th 2016 and he came over to visit for two weeks on the ESTA March 21st and had no problems whatsoever. May I ask how long you have been married? just wondering why yours was processed so fast and if perhaps ours will be as well!

Did you apply from here in the US then?
