MESSED UP!! ds-260 was sent too soon?

Timeline

I didnt contact NVC for a year, so we had to pay all over again. A week later it asked to fill out the form DS-260 this was about a month and a half ago-

Now, our paralegal is pissed saying that I shouldn't have done that because the I-601A WAIVER was just sent a few weeks ago and she says my husband might receive the interview appointment in Ciudad Juarez before even getting the waiver approved!!! DON'T KNOW WHAT TO DO!!!


I just received the receipt letter yesterday -on the waiver. Next will be the biomentric appointment locally- which we will have to wait until we receive it in the mail.

Everything is a mess. Can I contact NVC to hold our case so they know that the waiver is in process?

Did you already submit all documents to NVC? If not, you can hold off on submitting anything that's remaining until you get a decision on the waiver.

yes you can contact them and just let them know to not schedule the intervew yet due to the pending I601a.

Thank you both. I was about to contact NVC yesterday when I saw an emai. Luckily USCIS contacted NVC about my pending I-601A waiver. They mentioned that it will be on hold while NVC processes all of the paperwork.

Don't worry about it, is not a big deal as it seems.

We had to apply for an I-601a waiver for my wife. When USCIS notified NVC that we were applying for a waiver they sent us an email saying so, but if you read the email carefully it also says to continue replying to notices and requests for documents. So after my wife did her biometrics, I submitted her AOS, DS-260 and civil documents. For us it worked out really good cause we didn't have to wait long after USCIS approved her waiver. Basically the waiver got approved on 10/20 and by 10/22 NVC had scheduled her interview.

You can see on my signature below our timeline so you can have an idea.

10-21-18 N-400 Electronic filing.

10-29-18 Received biometrics notification.

11-26-18 Biometrics taken.

07-12-19 Interview letter received.

08-20-19 Interview passed!

08-30-19 N-445 Notice of Naturalization Oat Ceremony received.

09-24-19 Attended Naturalization Oat Ceremony, My wife is now an U.S. Citizen!

 

I-130 Wife filing for her parents.

09-25-19 I-130 for both her parents sent to Phoenix Lock Box.

10--04-10 NOA1 Received from Texas Service Center, priority date: 09-27-19

04-13-20 NOA2 received from USCIS for her mom. 04-14-20 NVC Welcome email received for her mom.

06-08-20 NOA2 received from USCIS for her father. 06-09-20 NVC email received for her father.

08/2020 Case completed at NVC, now just waiting for their interviews in Ciudad Juarez, Mexico.
07/2021 Received appointment to attend interview in Ciudad Juarez.
08/23/2021 First interview to basically drop off all the civil documents as requested, they waited about 3 hours.
08/24/2021 Second interview - This is the real interview with a State Dept Agent.  They waited for about 3 hours again before called in. Interview lasted about 5 minute.  -- approved!
10/09/2021 POE: California - Welcome to the USA.

10/09/2021 Paid for Green Card.

12/12/2021 Still waiting for GC's & SS#
