I married my spouse 3 years ago while I was here in the US, I had overstayed so I went back to the Netherlands and filed my paperwork there. My brother allowed my wife to stay with him (in the US) until I was approved. I finally got my 10 year greencard and I came back to the U.S. only to find out my brother and my wife had been having an affair. Well I want nothing to do with them but I'm afraid if I divorce I will lose my green card or any chance of becoming a U.S. citizen. Any advice? Can I divorce or am I stuck?

I obtained my green card because my spouse is a US citizen.

You can apply for citizenship after 5 years. I am sorry man.

Better take some time like one year extra to apply( could be more safe).

You got 10 year GC not the conditional one. So for your citizenship you don't need your wife and the marriage. Just divorce her don't worry. You can apply for your citizenship after 5 years by yourself.

Married 2001, conditional resident 2003, permanent resident 2005.Left U.S 2012, abandoned green card 2013.Applied I-130 Nov 2014, approved Dec 2014. DS260 13th Apr 2015. Docs sent 27 Apr. Scan date May 1. Case complete June 4!Interview July 14th, rescheduled to Oct 20th.  Applied for N400 on November 6th, 2018. I'm the immigrant :)

You got a 10 year GC, you got a divorce, in 5 years you can become a citizen without any issues.

21 Aug 2013: I-129F Sent

20 May 2014: Wedding!

The spouse that is sleeping with his brother? He would need to have a green card for 3 years and live with his USC wife for 3 years to naturalize under the 3 years rule. Do think he will be able to prove a bona fide marriage during those 3 years?
