what logicaly made no sense if you read the previous.....you "may" submit current pay stubs but its not required unless asked by a government official, well obviously your not gonna be asked by a government official until you get an RFE! thats what is not logical, get it?

I had the same problem. I found another JointSponsor who makes way more than what they are asking for, I have not sent back the Evidences but still working on them.
I have a question for you please, because as we know the 3 applications are seperated (the EAD,AP and the greencard), does the EAD get put on hold until we submit the RFE about the GreenCrad? or because they are separated they wont put it on hold ?

Yes, getting an RFE asking for the proof of current income would be an official asking for it. This is why it is always advised here on VJ, by most everyone, to send in the proof of your current income with the I-864 to avoid getting an RFE asking for it later. You list your current annual income amount, not past income from your taxes, and then you provide documents that show them that you in fact do earn that much annually. You can use a letter from employer and/or recent pay stubs. If you are currently earning $41k in a year's time, then that is what you list. Get your employer to state your position and salary, and/or send copies of your recent pay stubs.

Things work a bit differently for those that are self-employed, but that does not seem to be the case for you.

I had the same problem. I found another JointSponsor who makes way more than what they are asking for, I have not sent back the Evidences but still working on them.

I am glad I came across this post as I was debating sending the Employer letter and paystubs based on the "you "may" submit current pay stubs but its not required unless asked by a government official" statement.

Since I don't work I told a family member to help with the income. I say provide the most recent check stubs. A letter from your employer that you are a great worker..blah.blah. AAND a letter from a friend saying that you are very responsible.

A letter saying someone is responsible and a great worker does not proof income. Position, dates, income stated is needed in the employer letter.

It is very misleading.

As someone stated earlier, the RFE is the request by an official government official. It's one of those choices you make, do I send it in now or hope that the government official won't ask for it with a RFE letter or during the interview.

Well a government official might ask.........and now they're asking. They don't always ask....

The government saying "may" is a hint that you better go ahead and do it, or we (government officials) WILL come back and ask for it. :goofy: I sent EVERYTHING, even when they said they need current years tax return and I "may" send previous two. NO, you are getting it all at once; 3 years of tax returns, job letter, W-2s, 6 months of pay-stubs. I left no doubt in their mind if I met the income requirement or not and left them no room to come back and ask me for a single thing.

With God, all things are possible.

A letter from a friend saying you are responsible is useless and unnecessary. They are asking for evidence that you receive the income amount you list on the form. That is the only documentation they need and want to see, besides the required most recent tax return/transcript.

The simplest thing to do is to respond to the RFE instead of name-calling. Trying to convince everyone that the people asking for information are 'idiots' won't make those same government officials sit up in their chairs and say, 'oh, gosh, yes, person X is so right....after all, they have been my job for how long.......???'

Of course an employer letter will not hurt, the point is it is needed. The contents of such letter is not about being responsible, it is stating

income and position, date of employment. One month pay stub is not enough, at least 6 months is needed in most cases.

The simplest thing would be to list precise and clear instructions so no time will be wasted on RFE's, it is inefficient otherwise and EAD/AP

is put on hold.

Taking the guess work and the 'buts and maybes' out of the equation has absolutely nothing to do with an officer asking the above question.

Having done their jobs for so long should enlighten them on clear instructions and cut the "may" from it or stop asking with RFE's for every single

case. There are too many RFE's for the affidavit of support coming in lately and the forums are full of it. My goodness, USCIS is already back logged

enough as it is without further RFE clogs that could be avoided with logic in the instructions.
