well im one of the unlucky people that got an rfe for no reason. they say i didnt meet poverty guidelines, family of 4 = 30,312.00. I have NEVER grossed less then $45,000 in any of the last 10 years!!!! they also say they want current info!!! where anywhere does it ask for that? i sent in 4 years of tax transcripts, and 4 years of w-2's

I'm not familiar with the specifics of the AoS affidavit of support but often they often seem to appreciate a current letter from your employer and recent paystubs. This is the case for the K-1 affidavit of support anyway.

I'm sure others with more detailed knowledge will follow.

Part 6, item 2 asks for your current income. What amount did you enter here and how did you support the income claim?

An employer letter, paystubs are good evidence of current income.

it says you may submit current pay info, but its not required unless asked for by a government official!!! well duh when would they ask??? an RFE it even clearly says line 22 of the tax form 1040 which i sent that shows 48,000.00 gross!

Submit an employer letter and pay stubs, they have become very picky over proof of income and are sending out RFE's left and right.

The petitioner lists their current income on form i-864 as an amount to be considered sufficient, however no evidence has been submitted as proof as current income.

ok i agree with that i sent nothing of the current year and job, due to it saying you "May" want to but not required.

Based on the documents submitted with form i-864 the income did not meet the poverty guideline.

are they saying that because i didnt supply current job info???

how would current go with that box #2 when the year is not even over and know end number to evaluate? they clearly say last taxable year.

You must proof current income with employer letter and at least 6 pay stubs, I would send all you have from this year.

From what I have seen here on VJ they automatically say income not meeting guideline if something is missing proving current income.

You aren't self employed with line 22 issues and you did submit transcripts so send the missing items and you are good to go as I see it.

thank you, just very frustrating when i did exactly what the instructions said. they just have to make this whole process as hard as possible. if they were that worried about money they should do something prior to marrying a K-1.

If you are sure that the income meets the guideline then sending in # 1 will satisfy # 2. I see no reason for a joint sponsor.

Im assuming they are refering to gross income.

last year i grossed $48,000 this year i will gross $41,877. their guidelines say for a family of 4 is $30,312, there again im assuming they mean gross. so unless they are complete idiots they can read off my last 3 years of irs transcripts, ive exceeded that amount every year. so im hoping box #2 can only refer to "current job" still makes no sense logicaly, but what does when dealing with them.

What isn't logical about submitting evidence to support your current income claim? You annualize your current gross income ( for example: $100/week x 52 weeks = $5200) and complete the form. Attach an employer letter and several recent paystubs. That is what's needed for box 1 and box 2.

Neither "gross" nor "net" are appropriate terms here. The IRS uses the term "total income".

The I-864 instructions say that "total income" is considered if the sponsor filed a 1040 or 1040A, and "adjusted gross income" is considered if the sponsor filed a 1040EZ. This requirement bites a lot of self-employed people, as well, because they have more than adequate gross revenues but their schedule C deductions drastically reduces their total income.
